1. Public Notice Regarding COVID-19
This meeting was conducted virtually in accordance with the provisions stipulated
in Assembly Bill 361 and adopted by the Central San Board of Directors on
June 2, 2022. The agenda included instructions for options in which the public could
participate in the meeting.

4. Agenda Items
a. Receive "Engage" Employee Wellness Program 2021 Annual Report
Ms. Howard reviewed the presentation included in the agenda materials.
Member Lauritzen complimented staff for organizing and continuing the
program.
Chair Pilecki expressed his appreciation for the program and thanked Ms.
Howard for charging the lead.
COMMITTEE ACTION: Received the report.
b. Receive pension reform update associated with employees identified
under the estoppel class
Ms. O'Malley provided the Committee with the historical background of the
2014 pension reform litigation trial decision. The trial court decision had
created a group of employees referred to as the "estoppel class"for whom
the retirement benefit calculation allowed for additional hours of vacation
leave to be included in their final average salary (FAS) period which is
used to calculate the monthly pension benefit.
Ms. O'Malley advised that in July of 2020, the California Supreme Court
issued a decision which stated that the trial court order be vacated, and
the estoppel class was not lawful.
Ms. O'Malley noted that seven District employees were impacted as their
pension benefit had been calculated counting leave that should not have
been included in their FAS period. CCCERA (Contra Costa County
Employees'Retirement Association) implemented the decision and
reduced the pension for those impacted going forward, but also
determined that it would not collect on any overpayment retroactively that
had already been paid to the retiree.
All seven retirees were notified of this action in October of 2021 by
CCCERA. Since those retirees did make contribution amounts on each
calendar year sale of vacation hours (up to 160 hours) within their FAS
and they are no longer eligible for the higher pension benefit, which was
inclusive of two vacation sales (up to 320 hours), they are owed a refund
of their contributions. As CCCERA has determined not to collect any
overpayments that were owed, the refunds have been applied against the
overpayment amounts. The total amount received was approximately
$113,000 for all employees, averaging out to $6,500 per retiree.

Member Lauritzen confirmed there would be no claw back going forward.
Ms. O'Malley responded that was correct and that there were ranges of
monthly reductions, with the highest amount being $700.
Chair Pilecki thanked Ms. O'Malley for the response and stated he had no
further questions. He noted that the couple of retirees he spoke to
indicated they did not receive the letter from CCCERA.
Ms. O'Malley reiterated that she confirmed with CCCERA that they sent
out letters to all affected employees.
COMMITTEE ACTION: Received the update.
5. Announcements
Mr. Leiber announced that Central San would be participating in a State
program called the Low-Income Household Water Assistance Program
(LIHWAP) to assist low-income customers who did not pay their sewer
service charge bills during the pandemic for the period of March 2020
through June 2021. The State will commence the program later this
month, and Central San has coordinated with the State and the County
regarding how the funds will be received from the State and appropriately
credited to the customer.
Chair Pilecki reminded everyone to go out and vote.
