ISSUE
Section 6490 of the Health and Safety Code of the State of California provides that District ordinances
shall be published once in a newspaper of general circulation within the District, and further stipulates a
subsequent order of the Board that the ordinance had been published shall constitute conclusive evidence
that publication has been properly made.
BACKGROUND
A summary of uncodified District Ordinance No. 320, which was adopted by the Board on May 26, 2022,
was published on June 7, 2022 in the Contra Costa Times and San Ramon Valley Times, circulation
areas of the East Bay Times.
This ordinance established reimbursement fees for the properties which could directly connect to Central
San Job 6727 for the Cordell Drive West Contractual Assessment District (CAD) No. 2021-1, located in
Danville.

ALTERNATIVES/CONSIDERATIONS
Confirming publication of the ordinance summary establishes presumption that the ordinance was correctly
published and therefore would be deemed procedurally valid by a court.

Minimal cost associated to publication fees.

Program.
