Alm General Manager District Counsel ISSUE A resolution of the Board of Directors (Board) is required to accept irrevocable offers of dedications for sanitary sewer easements to convey real property interest to Central San and to authorize recording of the resolution. June 2, 2022 Regular Board Meeting Agenda Packet- Page 55 of 236 Page 2 of 4 BACKGROUND Warmington WC Associates, LLC (Developer) constructed new public sanitary sewers within new sanitary sewer easements (SSEs) in Walnut Creek with Job 6714. The Developer offered irrevocable offers of dedications for SSEs to Central San from a subdivision map. As Central San accepted the public sewers constructed with this job, staff recommends the Board accepts the irrevocable offers of dedications. ALTERNATIVES/CONSIDERATIONS The Board could decline to accept the irrevocable offer of dedication. This alternative is not recommended as Central San would not have recorded land rights that expressly states Central San has formally accepted the irrevocable offer of dedication to reconstruct, maintain or operate the public sanitary sewers that are owned by Central San. FINANCIAL IMPACTS None; the Developer paid the requisite fees to process these right of way documents and to record the resolution. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on May 18, 2022 and recommended approval. RECOMMENDED BOARD ACTION Adopt the proposed resolution accepting irrevocable offer of dedication for sanitary sewer easements from Warmington WC Associates, LLC related to Job No. 6714 in Walnut Creek, and authorizing staff to record the resolution with the Contra Costa County Recorder. FeetCalifornia State Plane,Zone III FIPS 0403,US Feet 1 June 2, 2022 Regular Board Meeting Agenda Packet- Page 57 of 236 Page 4 of 4 ATTACHMENT 2 RESOLUTION NO. 2022-029 A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT ACCEPTING A GRANT OF IRREVOCABLE OFFER OF DEDICATION FROM A MAP DEDICATION AS DEPICTED ON SUBDIVISION MAP 9521 FOR SANITARY SEWER EASEMENTS FROM WARMINGTON WC ASSOCIATES, LLC, AS RELATED TO JOB 6714 IN WALNUT CREEK BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (Central San) as follows: THAT Central San hereby accepts an irrevocable offer of dedication for sanitary sewer easements from a subdivision map from Warmington WC Associates, LLC, a California Limited Liability Company, which is more specifically referred to as "Subdivision 9521 — Pioneer Village, filed on June 29, 2021 in Book 547 of Maps at Pages 39-42, as Document Series 2021-0185996"; and THAT staff is authorized to record this resolution with the Contra Costa County Recorder.
