CENTRAL SAN BOARD OF DIRECTORS POSITION PAPER DRAFT MEETING DATE: JUNE 1, 2022 SUBJECT: REVIEW DRAFT POSITION PAPER TO AUTHORIZE THE GENERAL MANAGER TO EXECUTE A CONSTRUCTION CONTRACT CHANGE ORDER IN THE AMOUNT OF $300,000 WITH MCGUIRE & HESTER TO UPGRADE TO HIGH SECURITY FENCING AND GATES FOR THE CONTRACTOR STAGING IMPROVEMENTS, DISTRICT PROJECT 7375 SUBMITTED BY: INITIATING DEPARTMENT: WILLIAM GRANT, ASSOCIATE ENGINEER ENGINEERING AND TECHNICAL SERVICES- CAPITAL PROJECTS REVIEWED BY: NATHAN HODGES, SENIOR ENGINEER EDGAR J. LOPEZ, CAPITAL PROJECTS DIVISION MANAGER JEAN-MARC PETIT, DIRECTOR OF ENGINEERING AND TECHNICAL SERVICES ISSUE Authorization from the Board of Directors (Board) is required to execute a construction contract change order and to transfer funds in an amount greater than $ 200,000. BACKGROUND On May 6, 2021, the Board awarded a$4 million dollar construction contract to McGuire & Hester (M&H) for the Contractor Staging Improvements, District Project 7375 (Project). Construction of the project started last year in June 2021 and is scheduled to be completed by the end of this year. The contractor scope of work included civil improvements, installation of new utilities, and other similar work within the wastewater treatment plant (plant)to improve safety and site access for construction projects and deliveries. I n addition, the project includes a new security guard facility, fencing, and contractor entrance from Imhoff Drive as shown in Attachment 1. Since the project was awarded there have been several security issues involving breaches of existing chain link fencing around the plant and buffer properties. At the request from the Administration Department, mainly Risk Management, Capital Projects evaluated security fencing and put together several short and long-term plans to address known areas that require a higher level of security at the plant. June 1, 2022 EOPS Regular Committee Meeting Agenda Packet- Page 314 of 320 Page 2 of 5 As part of the construction contract, M&H is required to install typical chain link and barbed wired fencing as seen throughout most of the plant for the new contractor entrance. Staff spent significant time exploring and finding the appropriate high security fencing that would provide the level of security needed at Central San while being cost effective (example of security fence provided in Attachment 2). Several fencing suppliers and subcontractors were contacted and proposals given to M&H. The lowest cost received was from Bailey Fence Company, Inc. The upgrade to high security fencing at the project site will cost up to $300,000 and includes installation of 1,100 LF (linear feet) of galvanized iron perimeter fencing and gates, two industrial use gate operators with loop detectors and edge sensors, a swing arm gate, a personal gate with panic hardware, and 400 LF of chain link fence with barbwire for an internal plant parking lot. The work is expected to begin as soon as possible and be completed by September 1, 2022. ALTERNATIVES/CONSIDERATIONS The Board could consider the following alternatives or provide other direction: Alternative 1 - Do not proceed under a construction contract change order and issue the fencing work as a separate public works project and bid. This alternative would be more costly than staff's recommendation since semi-permanent fencing would need to be installed to secure the treatment plant until the new high security fencing can be bid, delivered, and installed. Staff also estimates the cost would be higher since a new contractor would have to mobilize and likely pay higher costs in handling low amounts of potentially hazardous soils. Alternative 2 - Postpone the high security fencing to another time. This is not recommended due to the potential re-work for the new entrance, exit, and guard facility security fencing. Construction traffic, workers, deliveries, and recreation vehicles are expected to use the new entrance; therefore, more people or the public will use a portion of the plant along Imhoff Drive. The action being recommended by staff is the most long-term economical solution and effectively helps complete the Contractor Staging Improvements project. FINANCIAL IMPACTS The total price for the fencing upgrades is $300,000, which includes labor and materials, shipping, taxes, and allowable contractor markups. Adequate funds are available within the Fiscal Year(FY) 2021-22 Capital Improvement Budget Contingency; therefore, upon Board approval, a budget transfer in the amount of$300,000 would be completed by the General Manager to fund this additional scope of work. COMMITTEE RECOMMENDATION The Engineering & Operations Committee reviewed this matter at its June 1, 2022 meeting and recommended RECOMMENDED BOARD ACTION Authorize the General Manager to execute a construction contract change order in the amount of $300,000 with McGuire & Hester to include high security fencing and gates for the Contractor Staging Improvements, District Project 7375.
