ISSUE
The Board of Directors (Board) must award the contract or reject bids within 50 days of the bid opening.
Authorization is also required for the General Manager to execute the Contract Documents subject to
submittal requirements.
BACKGROUND
The Central Contra Costa Sanitary District (Central San) operates a 3.5 mile, 72-inch reinforced concrete
outfall pipeline (outfall). The outfall, constructed in 1958, runs primarily underground for nearly 19,000 feet
and a submarine section of about 1,700 feet in length. Above the shoreline portion of the outfall, an
unvegetated, tidal mudflat extends approximately 1,000 feet from the shore and into Suisun Bay. Central
San also maintains a variety of infrastructure associated with the outfall, such as maintenance structures,
access risers, air relief valves, cathodic protection systems, inclinometers, and leveling monuments.

In 2020, the Outfall Improvements, Phase 7 Project(Outfall Phase 7) completed a full internal inspection
and survey of the pipeline as well as necessary repairs and improvements. Staff hired a specialty
consultant to evaluate the condition of the existing inclinometers and leveling monuments on the outfall.
The consultant's report recommended maintenance and repairs, as well as identified more than the
anticipated scope of work than previous Outfall Projects. The additional or unanticipated work included
replacement of several inclinometers and leveling monuments. Some of the repairs were completed;
however, other repairs or new inclinometers could not be performed during the timeline of the Outfall
Phase 7 construction period.
The Outfall Monitoring Improvements, District Project 100018 (Project), will replace and construct new
inclinometers and leveling monuments and perform non-routine maintenance on the existing systems. Staff
has coordinated with various agencies to obtain necessary approval and/or permits from the San
Francisco Bay Regional Water Quality Control Board, United States Army Corps of Engineers, United
States Fish and Wildlife Service, and California Department of Fish and Wildlife.
The Engineer's estimate for the Project is $390,000. This Project was advertised on March 21 and 28,
2022. One bid was received and publicly opened on April 14, 2022. The Capital Projects Division
conducted a technical and commercial review of the bid and determined that Power Engineering
Construction Company is a responsive and responsible bidder, with a bid amount of$444,000 as shown in
Attachment 2.Although the bid received is roughly$50,000 or 14 percent over the Engineer's estimate,
staff is recommending to award based on the following analysis of the bid and process:
• The scope of work under the Project is specialized and there was very limited interest by prospective
bidders. Staff contacted several contractors during the bid period and does not believe that
rebidding would bring additional interest.
• The costs for the new inclinometers were higher than anticipated and represent the difference
between the bid and Engineer's estimate.
• Rebidding will likely not save costs considering staff would have to spend significant time in bidding
again and extending the permits for the Project.
• Power Engineering Construction Company is uniquely familiar with the outfall infrastructure and has
successfully completed two of the Outfall Project Phases, thus has the expertise and knowledge to
perform the required work.
California Environmental Quality Act(CEQA)
At the October 21, 2021 meeting, the Board independently found this project to be exempt from the
California Environment Quality Act under CEQA Guidelines Section 15301.A Notice of Exemption was
filed with the Contra Costa County Clerk on October 21, 2021, as this was required before award of the
construction contract due to permitting.
ALTERNATIVES/CONSIDERATIONS
Proper maintenance of the outfall is required by the National Pollutant Discharge Elimination System
permit, which includes the inclinometers. Staff has reviewed whether to continue use of the inclinometers
as a tool for monitoring settlement and recommends continuing based on the historic settling of clay soils
or bay mud in and around the outfall alignment.
FINANCIAL IMPACTS
The total estimated cost for the Project is $789,000, which includes planning, design, construction
contract, contingency, and construction management costs as shown in Attachment 3. The Outfall
Monitoring Improvements Project is included in the FY 2021-22 District Budget on page 257 with a total
budget of$610,000.A transfer of$179,000 from the FY 2021-22 Capital I mprovement Budget

contingency account is needed to fund the Project. The transfer amount is within the General Manager's
delegated authority and will be done if the Board awards the contract.
COMMITTEE RECOMMENDATION
The Engineering and Operations Committee has reviewed this subject at its meeting on May 4, 2022 and
recommended approval.
RECOMMENDED BOARD ACTION
Staff recommends the Board award a construction contract in the amount of $444,000 to Power
Engineering Construction Company, the lowest responsive and responsible bidder for the Outfall
Monitoring Improvements, District Project 100018.
