BACKGROUND Staff received an application to review site development plans for a small subdivision where Central San had an existing sanitary sewer in an easement crossing the larger parcel. I n order to provide services to the new parcels, the applicant met with Central San to mitigate the encroachments by ensuring adequate crossing angles and clearances from the sanitary sewer and strategically locate a paved driveway to allow vehicular access to an existing manhole at the back of a parcel. To authorize these encroachments so the subdivision can occur, staff requested the property owner enter into a real property agreement for the proposed Class 2 encroachments, in compliance with Chapter 7 of District Code. ALTERNATIVES/CONSIDERATIONS Reject the request for a real property agreement. This alternative is not recommended since the property May 18, 2022 REEP Committee Meeting Agenda Packet- Page 17 of 47 Page 2 of 3 owner would be unable to subdivide the property, and they have reasonably mitigated the impact and are willing to enter into the real property agreement in compliance with District Code. FINANCIAL IMPACTS A development-related fee was paid by the property owner for the real property agreement, as set by District Ordinance No. 317. COMMUNITY OUTREACH COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on May 18, 2022 and recommended RECOMMENDED BOARD ACTION Adopt a resolution authorizing execution of a real property agreement related to1024 and 1026 Grayson Road, in unincorporated Pleasant Hill, and authorizing staff to record the documents with the Contra Costa County Recorder.
