ISSUE
Section 6490 of the Health and Safety Code of the State of California provides that District ordinances
shall be published once in a newspaper of general circulation within the District, and further stipulates a
subsequent order of the Board that the ordinance had been published shall constitute conclusive evidence
that publication has been properly made.
BACKGROUND
A summary of uncodified District Ordinance No. 319, which was adopted by the Board on March 17, 2022,
was published in the Contra Costa Times and San Ramon Valley Times on March 31, 2022. Proof of
publication is attached.
Ordinance No. 319 amended District Code 2.04.030, paragraph A to increase the Board Member
compensation from $185 to $200 per meeting as allowed under both the California Health and Safety, and
Water codes. The maximum allowance of one stipend per applicable meeting day, and six meeting days
per month remain unchanged.

In conformance with the California Water Code Section 20204, this ordinance will be become effective
May 17, 2022, 60 days after adoption.
ALTERNATIVES/CONSIDERATIONS
Confirming publication of the ordinance summary establishes presumption that the ordinance was correctly
published and therefore would be deemed procedurally valid by a court.
FINANCIAL IMPACTS
Minimal cost associated to publication fees.
COMMITTEE RECOMMENDATION
This item was not reviewed by a Board Committee.
