DCENTRALSAN MEETING DATE: FEBRUARY23, 2022 BOARD OF DIRECTORS POSITION PAPER DRAFT SUBJECT: REVIEW DRAFT POSITION PAPER TO ADOPT RESOLUTION NO. 2022- ACCEPTING A MAP DEDICATION FROM LOWE'S HOME CENTER, LLC (PROPERTY OWNER) FOR SANITARY SEWER PURPOSES AND AUTHORIZING STAFF TO RECORD THE RESOLUTION WITH THE CONTRA COSTA COUNTY RECORDER SUBMITTED BY: INITIATING DEPARTMENT: STEPHANIE GRONLUND, ASSOCIATE ENGINEERING AND TECHNICAL SERVICES - ENGINEER PDS-DEVELOPMENTSERVICES-MAINLINE REVI EW REVIEWED BY: DANA LAWSON, SENIOR ENGINEER DANEA GEMMELL, PLANNING AND DEVELOPMENT SERVICES DIVISION MANAGER JEAN-MARC PETIT, DIRECTOR OF ENGINEERING AND TECHNICAL SERVICES ISSUE A resolution of the Board of Directors (Board) is required to accept offers of dedications of sanitary sewer easements as depicted on subdivision maps to convey real property interest to Central San and to authorize recording of the resolution. BACKGROUND Lowe's Home Center, LLC (Property Owner) constructed a public sanitary sewer within a sanitary sewer easement in the City of Concord with Job 6721. To provide the necessary land rights to the public sanitary sewer, the Property Owner offered Central San sanitary sewer easements on a subdivision map that was filed with Contra Costa County Recorder. As the public sanitary sewer was constructed and accepted per Central San's standards, staff recommends the Board accepts this sanitary sewer easement offer. ALTERNATIVES/CONSIDERATIONS The Board could decline to accept the offer of dedication of sanitary sewer easements. This alternative is February 23, 2022 REEP Committee Meeting Agenda Packet - Page 19 of 77 Page 2 of 4 not recommended as Central San would not have recorded land rights to reconstruct, maintain, or operate the public sanitary sewers that are owned by Central San. FINANCIAL IMPACTS None; as the Property Owner paid the fees to process and record this acceptance. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on February 23, 2022 and recommended RECOMMENDED BOARD ACTION Adopt the proposed resolution accepting a map dedication from Lowe's Home Centers, LLC for sanitary sewer purposes and authorizing staff to record the resolution with the Contra Costa County Recorder.
