ISSUE
A resolution of the Board of Directors (Board) is required to execute a common use agreement and to
record the document with the Contra Costa County Recorder.

BACKGROUND
The City of San Ramon (City) is constructing a pedestrian bridge over Bollinger Canyon Road along the
Iron Horse Corridor. Portions of the pedestrian bridge will encroach on Central San's easement. Staff
requested that the City enter into a common use agreement with Central San for the pedestrian bridge,
similar to a real property agreement which authorizes an encroachment.A common use agreement is used
when a public agency is the other party to the agreement.
Additionally, the City's consulting engineer has included mitigation measures into the design with a casing
and a protective cap to facilitate future renovation of the force main. The consulting engineer also ensured
that the landscaping plans would not plant any trees within Central San's existing easement.
ALTERNATIVES/CONSIDERATIONS
Reject the proposed common use agreement. This alternative is not recommended since the City is
willing to enter into the agreement, in compliance with Central San's previous practices with pedestrian
bridges in the Iron Horse Corridor.
FINANCIAL IMPACTS
None. Central San is requiring the contractor to obtain a Special Inspection Permit to monitor the
construction activities within the easement and the contractor will pay permit fees in accordance with the
current Ordinance at that time.
COMMITTEE RECOMMENDATION
The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on January
26, 2022 and recommended approval.
RECOMMENDED BOARD ACTION
Adopt a resolution authorizing execution of a common use agreement related to the I ron Horse Corridor at
Bollinger Canyon Road, San Ramon, and authorizing staff to record document with the Contra Costa
County Recorder.

A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT
AUTHORIZING THE EXECUTION AND RECORDING OF A COMMON USE AGREEMENT
RELATED TO THE IRON HORSE CORRIDOR AT
BOLLINGER CANYON ROAD, SAN RAMON
BE IT RESOLVED by the Board of Directors of Central Contra Costa Sanitary District
(Central San) as follows:
THAT Central San hereby authorized to execute a Common Use Agreement with the City of
San Ramon:
THAT the President of the Board of Directors and the Secretary of the District are hereby
authorized to execute said document for and on behalf of Central San; and
THAT staff is authorized to record the documents in the office of the Recorder of Contra
Costa County.
