ISSUE
A resolution of the Board of Directors (Board) is required to accept a grant of easement for sanitary sewer
easements to convey real property interest to Central San.
BACKGROUND
The property owner applied for a permit for a backyard remodel at 2007 Scarlet Oak Place, Danville, CA
94506, APN: 203-251-007. As part of the encroachment verification process, staff discovered that the 10'
Sanitary Sewer Easement (SSE)was not properly depicted on Subdivision Map 4878 for the existing
sewer.
I n 1982, the error was identified and Central San contacted Bryan and Murphy Associates I nc. (the
engineering firm for the Hidden Oaks development)to obtain Grant of Easements from affected property
owners. Recent review of the parcel indicated that an easement at 2007 Scarlet Place was not obtained.
Staff contacted the property owner, who agreed to provide a new grant of easement to Central San.
One remaining parcel has been identified and right of way staff will follow up with this property owner to
obtain the necessary land rights.

ALTERNATIVES/CONSIDERATIONS
The Board could decline to accept the Grant of Easement. This alternative is not recommended since
Central San would not have the easement rights necessary to protect its pipe.
FINANCIAL IMPACTS
The grant of easement for sewer purposes was acquired for$500 to compensate the property owner for
their time in resolving this matter.
COMMITTEE RECOMMENDATION
The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on January
26, 2022 and recommended
RECOMMENDED BOARD ACTION
Adopt the proposed resolution accepting the executed Grant of Easement related to 2007 Scarlet Oak
Place, Danville (APN 203-251-007) related to Job 2788 and authorizing staff to record documents with the
Contra Costa Recorder.

BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary
District (Central San) as follows:
THAT Central San hereby accepts a Grant of Easement dated December 13, 2021 ,
from the following property owner:
Ben Freeman and Ashley Brennan
2007 Scarlet Oak Place
Danville, CA 94506
APN: 203-251-007
THAT staff is authorized to record the document in the office of the Recorder of Contra
Costa County.
