ISSUE
Section 6490 of the Health and Safety Code of the State of California provides that District ordinances
shall be published once in a newspaper of general circulation within the District, and further stipulates a
subsequent order of the Board that the ordinance had been published shall constitute conclusive evidence
that publication has been properly made.
BACKGROUND
A summary of uncodified District Ordinance No. 318, which was adopted by the Board on October 21,
2021, was published in the Contra Costa Times and San Ramon Valley Times on October 28, 2021.
In accordance with District Code 6.20, Ordinance No. 318 established the reimbursable fee applicable to
parcels that could connect to standard sewer facilities under Job 6712, La Sonoma Way in Alamo.

ALTERNATIVES/CONSIDERATIONS
Confirming publication of the ordinance summary establishes presumption that the ordinance was correctly
published and therefore would be deemed procedurally valid by a court.
FINANCIAL IMPACTS
Minimal cost associated to publication fees.
