Ability to Change Election Laws
• The California Electoral Code permits local
governments to operate within the confines of their
jurisdiction as they see fit, so long as their conduct
does not discriminate against protected classes of
voters.
• California Electoral Code does not expressly prohibit
a special district from implementing alternative
voting methods.
Ability to Change Election Laws
• EC 15154 (c): "If a voter indicates, either by
combination of both marking and writing in, a choice
of more names than there are candidates to be
elected or nominated for any off ice, or

counted, but the remainder of the ballot, if properly
marked, shall be counted."
