Alm General Manager District Counsel ISSUE A resolution of the Board of Directors (Board) is required to accept irrevocable offers of dedications by separate instrument and to accept offers of dedications of sanitary sewer easements as depicted on subdivision maps to convey real property interest to Central San, and to authorize recording of said documents. September 2, 2021 Regular Board Meeting Agenda Packet- Page 39 of 199 Page 2 of 5 BACKGROUND Gloria Terrace, LLC constructed a public sanitary sewer within a sanitary sewer easement in Lafayette with Job 6684. The developer offered Central San a sanitary sewer easement on a subdivision map that was filed with the Contra Costa County Recorder. As the sewerjob also included an offsite public sewer on lands owned by Lori Maher, the developer obtained a Grant of Irrevocable Offer of Dedication (Easement for Sewer Purposes)from this adjoining property owner. As the public sanitary sewer was constructed and accepted per Central San's standards, staff recommends the Board accepts the recorded grant of irrevocable offer of dedication and the map dedication of a sanitary sewer easement. ALTERNATIVES/CONSIDERATIONS The Board could decline to accept the irrevocable offer of dedication and the map offer. This alternative is not recommended as Central San would not have recorded land rights to reconstruct, maintain, or operate the public sanitary sewers that are owned by Central San. FINANCIAL IMPACTS None; as the applicant paid the fees to process these right of way documents and to record this resolution. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee considered this matter at its meeting on August 16, 2021 and recommended approval. RECOMMENDED BOARD ACTION Adopt the proposed resolution accepting an irrevocable offer of dedication from Lori Maher for sanitary sewer purposes, accepting a map dedication from Gloria Terrace, LLC for sanitary sewer purposes, and authorizing staff to record the resolution with the Contra Costa County Recorder. Feet California State Plane,Zone III FIPS 0403,US Feet 1 September 2, 2021 Regular Board Meeting Agenda Packet- Page 41 of 199 Page 4 of 5 ATTACHMENT 2 RESOLUTION NO. 2021-046 A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT ACCEPTING A GRANT OF IRREVOCABLE OFFER OF DEDICATION FROM LORI MAHER, ACCEPTING A MAP DEDICATION AS DEPICTED ON SUBDIVISION MAP 9429 FOR SANITARY SEWER EASEMENTS AS RELATED TO JOB 6684 IN LAFAYETTE BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (Central San) as follows: THAT Central San hereby accepts a sanitary sewer easement as recorded in the Grant of Irrevocable Offer of Dedication, which is more specifically referred to as "Grant of Irrevocable Offer of Dedication (Easement for Sanitary Sewer Purposes) from Lori Maher for APN 166-200-026, Job No. 6684 - ROW Parcel No. 2", which was recorded on October 18, 2019 as Document Series No. 2019-0178042 with the Contra Costa County Recorder; and THAT Central San hereby accepts the sanitary sewer easement offer from Gloria Terrace, LLC, a California Limited Liability Company as stated in subdivision map, which is more specifically referred to as "Subdivision 9429 — Gloria Terrace Estates, and map was filed on June 29, 2021 in Book 547 of Maps at Pages 33-38 as Document Series 2021-0185907"; and THAT staff is authorized to record this resolution with the Contra Costa County Recorder.
