ISSUE
A resolution of the Board of Directors is required to execute a real property agreement for any proposed
Class Two Encroachments.

BACKGROUND
Habitat for Humanity(applicant)will be installing 42 residential condominium units in Walnut Creek, which
will require construction of a public sewer main within a Sanitary Sewer Easement (SSE). To comply with
the city's conditions of approval for development purposes, the applicant needs to construct amenities, as
listed below, within the SSE that are defined as Class One and Class Two Encroachments (Central San
Code 7.15.010.B).

Benches (Class One)
Good Neighbor Fence (Class One)
Mailboxes on Pedestal (Class One)
Permeable Pavers (Class One)
Sound Fence & Gate (Class One)
Footings for Sound Fence (Class Two)
Reinforced Concrete Pavement (Class Two)
Staff initially rejected all encroachments within the new SSE. The applicant's architect did remove some of
the amenities, such as bike lockers on concrete pads, and a permanent basketball hoop; however, for the
remaining encroachments they could not find other suitable locations within the affordable housing project
outside the SSE, which is why staff requested the applicant to enter into a Real Property Agreement
(RPA)with Central San. While staff has the authority to address Class One Encroachments, all have been
included in this RPA for completeness.
ALTERNATIVES/CONSIDERATIONS
Reject the proposed encroachments. This alternative is not recommended since the applicant is willing to
enter into the real property agreement in compliance with District Code and this rejection could impact the
development schedule.
FINANCIAL IMPACTS
Prior to issuing the sewer permit, the applicant will be required to pay the development-related fee for the
RPA, as set by the latest District Ordinance.
COMMITTEE RECOMMENDATION
The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on July 20,
2021 and recommended approval.
RECOMMENDED BOARD ACTION
Adopt the proposed resolution authorizing the execution of a real property agreement related to 1250 Las
Juntas Way in Walnut Creek and authorizing staff to record the documents with the Contra Costa County
Recorder.

BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary
District (Central San) as follows:
THAT Central San hereby authorized to execute a Real Property Agreement with the
following property owner:

THAT the President of the Board of Directors and the Secretary of the District are
