Alm General Manager District Counsel ISSUE A resolution of the Board of Directors (Board) is required to accept offers of dedications of sanitary sewer easements as depicted on subdivision maps to convey real property interest to Central San and to authorize recording of said documents. August 5, 2021 Regular Board Meeting Agenda Packet- Page 80 of 262 Page 2 of 4 BACKGROUND Developer and property owner Coral Homes, LLC, a California Limited Liability Company (Applicant), constructed a public sanitary sewer within a sanitary sewer easement in City of Walnut Creek with Job 6683. To provide the necessary land rights to the public sanitary sewer, the Applicant offered Central San sanitary sewer easements on a subdivision map that was filed with Contra Costa County Recorder. As the public sanitary sewer was constructed and accepted per Central San's standards, staff recommends the Board accepts this sanitary sewer easement offer. ALTERNATIVES/CONSIDERATIONS The Board could decline to accept the offer of dedication of sanitary sewer easements. This alternative is not recommended as Central San would not have recorded land rights to reconstruct, maintain or operate the public sanitary sewers that are owned by Central San. FINANCIAL IMPACTS None; as the property owner paid the fees to process and record this acceptance. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on July 20, 2021 and recommended approval. RECOMMENDED BOARD ACTION Adopt the proposed resolution accepting a map dedication from Coral Homes, LLC, a California Limited Liability Company, for sanitary sewer purposes; and authorizing staff to record the resolution with the Contra Costa County Recorder. Feet California State Plane,Zone III FIPS 0403,US Feet August 5, 2021 Regular Board Meeting Agenda Packet- Page 82 of 262 Page 4 of 4 ATTACHMENT 2 RESOLUTION NO. 2021-040 A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT ACCEPTING A MAP DEDICATION AS DEPICTED ON MINOR SUBDIVISION MAP MS 802-17 FOR SANITARY SEWER EASEMENT AS RELATED TO JOB 6683 IN WALNUT CREEK BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (Central San) as follows: THAT Central San hereby accepts the sanitary sewer easement offer from Coral Homes, LLC, a California Limited Liability Company as stated in minor subdivision map, which is more specifically referred to as "Parcel Map, Minor Subdivision MS 802-17 for Condominium Purposes, and map was filed on September 12, 2019 in Book 215 of Parcel Maps at page 25 as Document Series 2019-0150074"; and THAT staff is authorized to record this resolution with the Contra Costa County Recorder.
