Alm General Manager District Counsel ISSUE A resolution of the Board of Directors (Board) is required to accept a grant of easement for sanitary sewer easements to convey real property interest to Central San. BACKGROUND PG&E operates a natural gas valve station on Olympic Boulevard in Lafayette. PG&E is in the process of acquiring the property next to the station located at 3244 Andreasen Drive, Lafayette (AP N: 238-060-021- 9), to install upgrades to the station, including inspection facilities. Central San owns a 27-inch diameter August 5, 2021 Regular Board Meeting Agenda Packet- Page 64 of 262 Page 2 of 3 sewer that traverses 3244 Andreasen Drive in an area where PG&E is proposing to cross the sewer with a pipeline that will be used on an occasional basis to insert inspection equipment into their transmission line. Per staff's request, PG&E entered into a Memorandum of Understanding (MOU) on August 19, 2019 and an Agreement Relating to Real Property on September 5, 2019, which was subsequently recorded on September 10, 2019 as Document Series Number 2019-0148580 in the Contra Costa County Recorder's Office. Per the terms of the MOU, PG&E agreed to grant Central San additional easement rights, widening their current easement from 12 feet to 20 feet to meet current easement standards and preserve access to Central San's facilities, once approval from the California Public Utilities Commission (CPUC)was granted. A Grant of Easement has been executed by PG&E and is now ready for Board approval and recording. ALTERNATIVES/CONSIDERATIONS The Board could decline to accept the Grant of Easement. This alternative is not recommended since upgrades to the natural gas valve station are intended to improve its reliability and safety, and PG&E has agreed to Central San staff's conditions for protecting the sewer line and for inspection requirements. FINANCIAL IMPACTS PG&E agreed to reimburse Central San for processing the agreements, plan review, and inspection costs, in the amount of $432 along with the fees related to the Real Property Agreement in the amount of$1,432. Central San compensated PG&E fair market value for the new easement area, which is a CPUC requirement, in the amount of$17,000. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on July 20, 2021 and recommended approval. RECOMMENDED BOARD ACTION Adopt the proposed resolution accepting the executed Grant of Easement and authorizing staff to record documents with the Contra Costa County Recorder.
