A resolution of the Board of Directors is required to execute a real property agreement f or any proposed
C lass Two E ncroachments.
B AC K G RO UND
Habitat for Humanity (applicant) will be installing 42 residential condominium units in Walnut Creek, which
will require construction of a public sewer main within a Sanitary S ewer E asement (S S E ). To comply with
the city’s conditions of approval for development purposes, the applicant needs to construct amenities, as
listed below, within the S S E that are def ined as Class One and Class Two Encroachments (C entral San
C ode 7.15.010.B).

Staf f initially rejected all encroachments within the new S S E. T he applicant's architect did remove some
of the amenities, such as bike lockers on concrete pads, and a permanent basketball hoop; however, for
the remaining encroachments they could not f ind other suitable locations within the af f ordable housing
project outside the S S E , which is why staff requested the applicant to enter into a R eal P roperty
Agreement (R PA ) with Central S an. W hile staff has the authority to address Class One E ncroachments,
all have been included in this R PA for completeness.

R eject the proposed encroachments. T his alternative is not recommended since the applicant is willing to
enter into the real property agreement in compliance with District Code and this rejection could impact the
development schedule.
F I NANC IAL I M PAC T S
Prior to issuing the sewer permit, the applicant will be required to pay the development-related fee f or the
R PA , as set by the latest District Ordinance.

AUTHORIZING EXECUTION AND RECORDING
A REAL PROPERTY AGREEMENT AT 1250 LAS JUNTAS WAY
IN WALNUT CREEK
BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary
District (Central San) as follows:
THAT Central San hereby authorized to execute a Real Property Agreement with the
following property owner:
Assessors’ Parcel Numbers: 148-180-050, 148-180-051, 148-180-052
Property Owner: Habitat for Humanity East Bay / Silicon Valley
Site Address: 1250 Las Juntas Way, Walnut Creek
THAT the President of the Board of Directors and the Secretary of the District are
hereby authorized to execute said Real Property Agreement for and on behalf of Central
