A resolution of the Board of Directors is required to execute a real property agreement and to record the
document with the Contra Costa County Recorder.
B AC K G RO UND
S taff received an application to review building plans f or B lackhawk Country Club, located in the Town of
Danville, in unincorporated Contra Costa C ounty, f or the construction of solar panel carports. Staff
identified that the conduit for the solar carports would encroach across an existing sanitary sewer
easement. The existing 10’ sanitary sewer easement was established via Map of Subdivision 5441, filed
J une 10, 1980, in B ook 240 of Maps at Page 7 in the C ontra C osta County R ecorder’s Of f ice. Staff
requested the property owner enter into a real property agreement for the proposed subsurf ace
improvements that will encroach into our easement and are classified as Class 2 encroachments under
Chapter 7 of the D istrict C ode.

Reject the proposed improvements. This alternative is not recommended since the property owner is
willing to enter into the real property agreement in compliance with the D istrict C ode and the level of
interf erence has been minimized so that it does not impact the operation nor maintenance of the sanitary
sewer.

A development-related f ee was paid by the property owner f or the real property agreement, as set by
District Ordinance No. 310.

EXECUTING AND RECORDING A REAL PROPERTY AGREEMENT

BE IT RESOLVED by the Board of Directors of Central Contra Costa Sanitary District
(Central San) as follows:
THAT Central San hereby authorized to execute a Real Property Agreement with the
following property owner related to the indicated property:
Assessors’ Parcel No.: 203-520-004
Property Owner(s): Blackhawk Country Club, a California non-profit
Mutual benefit corporation
Site Address: 599 Blackhawk Club Drive, Danville, CA 94506
THAT the President of the Board of Directors and the Secretary of the District are hereby
authorized to execute said documents for and on behalf of Central San; and
THAT staff is authorized to record the documents in the office of the Recorder of Contra
Costa County.
