Alm General Manager District Counsel ISSUE A resolution of the Board of Directors (Board) is required to: accept a grant of easement for recycled water purposes; accept irrevocable offers of dedications of sanitary sewer easements to convey real property interest to Central San; authorize execution of a quitclaim deed for sewer purposes for Central May 20, 2021 Regular Board Meeting Agenda Packet- Page 58 of 457 Page 2 of 7 San to release real property interest; and to authorize recording of said documents. BACKGROUND The scope of this multiple agency project is to construct a new public library, sports field, and public roadway, and to partner with a developer to construct new residences in Pleasant Hill. The Central San infrastructure work includes extension of new sewer mains, relocation of a sewer main, and extension of the recycled water distribution system. Numerous land swaps from the various agencies have occurred between Contra Costa County, City of Pleasant Hill, Mount Diablo Unified School District, and Pleasant Hill Recreation and Park District. The Irrevocable Offers of Dedications for sewer purposes were granted from the current property owners at the time of recording, and subsequent to the recordings some of the parcel shapes and property owners have changed, which is depicted on Attachment 1. No change of ownership has occurred for the Grant of Easement for recycled water purposes that will be recorded post- Board acceptance. ALTERNATIVES/CONSIDERATIONS The Board could decline to accept the grant of easement and the irrevocable offers of dedications. This alternative is not recommended as Central San would not have recorded land rights to reconstruct, maintain, or operate the public sanitary sewers and recycled water mains that are owned by Central San. The Board could also decline to quitclaim the unused sewer easement, although this action would increase Central San's potential liability for lands without public sewers. FINANCIAL IMPACTS None; as the Applicants paid fees to process and record these documents. COMMITTEE RECOMMENDATION The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on May 3, 2021 and recommended approval. RECOMMENDED BOARD ACTION Staff recommends the following: 1. Adopt the proposed resolution accepting a grant of easement from Mount Diablo Unified School District for recycled water purposes; 2. Adopt the proposed resolution accepting irrevocable offers of dedications from Contra Costa County and City of Pleasant Hill, authorizing execution of quitclaim deed to City of Pleasant Hill, or the current property owner at the time of recording, for sanitary sewer purposes; and 3. Authorize staff to record the documents with the Contra Costa County Clerk-Recorder.
