ISSUE
Prior to entering into any lease of real property owned by Central San, the Board of Directors (Board) must
conduct a public hearing and make a finding that the subject property will be used for compatible uses, that
it will be of public benefit, and that the term of the lease will not exceed ten years. The Board must also
declare the property as unneeded for District purposes during the term of the lease.

BACKGROUND
Board Policy No. B P 043 - Buffer Property Management was approved on April 15, 2021. This new
policy set criteria for leasing buffer properties, that are located between the treatment plant and the
surrounding properties not owned by Central San. Currently, three tenants on buffer properties require
extensions to their lease agreements. All three buffer properties meet the criteria set forth in BP 043.
The Lagiss property is comprised of approximately 48 acres, located northwest of the Martinez Treatment
Plant on Assessor's Parcel No. 159-140-042.
The County Quarry property is located at 5501 Imhoff Drive, northeast of the Martinez Treatment Plant,
Assessor's Parcel No. 159-140-052, and consists of 7.58 acres.
The Triangle property is located directly west of the Household Hazardous Waste Facility and west of the
Martinez Treatment Plant on a portion of Assessor's Parcel No. 159-150-057 and is approximately 0.7
acres.
ALTERNATIVES/CONSIDERATIONS
A public hearing is required. The Board may decline to establish the recommended public hearing date or
may elect to choose a different date; however, if the properties are to be leased, then a public hearing
must be held to declare the properties as "currently unneeded".
FINANCIAL IMPACTS
The District will receive additional rental income. The actual amount will depend on the individual lease
and agreement terms.
COMMITTEE RECOMMENDATION
The Real Estate, Environmental, and Planning Committee will review this matter at its meeting on May
3, 2021 to make recommendations for the public hearing at the May 20, 2021 Board meeting.
The setting of the public hearing date was not reviewed by a Board Committee.
RECOMMENDED BOARD ACTION
Set a public hearing for May 20, 2021 at 1:30 p.m. to receive comments on declaring District-owned
properties commonly known as "Lagiss", "County Quarry", and the "Triangle" as currently unneeded for
District purposes and authorize staff to execute and administer lease agreements with terms not to exceed
ten years.
