ISSUE
District Code requires that a public hearing be held prior to Board of Directors (Board) consideration of
revisions to the District Code.
Additionally, State Law and District Code require that a public hearing be held prior to Board approval of
changes to Capacity Fees and related programs.

BACKGROUND
As part of a periodic review of the District Code, staff has identified various changes required in order to
conform with external requirements, internal practices, and to otherwise enable the more efficient
management of District operations.
These updates to Central San District Code will require changes to language regarding the District's
Capacity Use Charge program currently found in Exhibit A to Ordinance 309, "Schedule of Capacity Fees,
Rates, and Charges".
State law and District Code require that a public hearing be held prior to Board consideration of revisions
to the District Code and the Schedule of Capacity Fees, Rates, and Charges.
Legal notices will be published in the Contra Costa Times and the San Ramon Valley Times. The
Notices of Public Hearing will be posted on Central San's website.
ALTERNATIVES/CONSIDERATIONS
The Board may set the two public hearings at the recommended date/time or select a different date/time.
As these public hearings are related, they should be scheduled together.
FINANCIAL IMPACTS
None to set the public hearings.
COMMITTEE RECOMMENDATION
The Finance Committee reviewed the proposed changes to the District Code at its February 3, 2021
meeting. Updates related Ordinance 309 is scheduled for review by the Finance Committee on February
23, 2021 meeting.
RECOMMENDED BOARD ACTION
Set two separate public hearings for March 18, 2021 at 1:30 p.m. to receive comments on (1) proposed
updates to various sections of the District Code, and (2) amending Exhibit to Ordinance No. 309 to
address the related changes to the Schedule of Capacity Fees, Rates, and Charges.
