• Replace existing emergency bypass pipe between Manhole 11 and DSRSD

BOARD AUTHORIZED GENERAL MANAGER TO
EXECUTE DERWA TEMPORARY DIVERSION
AGREEMENT ON JANUARY 17, 2019
• Initial term is 3 years with two 1-year extensions possible (by mutual
written agreement), not to exceed a total of 5 years
• If Central San "reasonably determines" operation of the project is no
longer consistent with the Nine Guiding Principles, Central San may
terminate the Agreement
• DERWA is responsible for the cost to design and construct the project
• If Central San terminates the Agreement within the initial term, the
Parties will meet in good faith to determine the appropriate Central San
reimbursement to DERWA, if any
• Requires annual reporting by DERWA on:
o Project's adherence to the Guiding Principles
o DERWNs efforts to develop alternative water supplies
