ISSUE
A resolution of the Board of Directors (Board) is required to accept a grant of easement that conveys real
estate property interest to Central San.
BACKGROUND
Raymond Peter de la Cruz (property owner) has a public sanitary sewer on his vacant lot. This sewer,
which was constructed by the City of Martinez in 1954, does not have a recorded sewer easement. To
perfect the land title of his parcel, the property owner has signed a grant of easement for sewer purposes
to Central San.
ALTERNATIVES/CONSIDERATIONS
The Board could decline to accept the grant of easement. This alternative is not recommended as Central
San would not have recorded land rights to reconstruct, maintain, or operate the public sanitary sewers that
are owned by Central San.

FINANCIAL IMPACTS
The grant of easement for sewer purposes was acquired at no cost to Central San.
COMMITTEE RECOMMENDATION
The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting
on December 14, 2020 and recommended
RECOMMENDED BOARD ACTION
Adopt a resolution accepting the grant of easement from Raymond Peter de la Cruz as stated in the
attached proposed resolution, as related to Job x1810, located in the City of Martinez.

A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT
ACCEPTING A GRANT OF EASEMENT FROM RAYMOND PETER DE LA CRUZ
FOR SEWER PURPOSES AS RELATED TO JOB X1810
LOCATED IN THE CITY OF MARTINEZ
BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary
District (Central San) as follows:
THAT Central San hereby accepts the easement from Raymond Peter de la Cruz as
stated in a Grant of Easement, which is more specifically referred to as "Grant of
Easement (Sewer Purposes) for APN 372-323-001, Job No. x1810 - ROW Parcel 2";
and
THAT staff is authorized to record the grant of easement and this resolution with the
Contra Costa County Recorder.
PASSED AND ADOPTED this 7th day of January, 2021 by the Board of Directors of
