ISSUE
A resolution of the Board of Directors (Board) is required for execution of quitclaim deeds and to record
the documents.

BACKGROUND
As the initial sewer plan was to sewer to the north to provide service for the Seclusion Valley properties,
located in the unincorporated area of Lafayette, two filed subdivision maps offered and dedicated sanitary
sewer easements to Central San. However, development of the improvement plans reversed the flow of
the sewer to the south, due to advanced survey and engineering work.
Job 6619 was constructed within the public right-of-way and is accepted by Central San staff. Therefore,
the change in sewer alignment from planned to actual has rendered the previously offered easements as
obsolete; no public sewers were constructed, nor will be constructed within these easements.
ALTERNATIVES/CONSIDERATIONS
The Board could decline to quitclaim these unused easements, although this action would increase Central
San's potential liability for lands without public sewers.
FINANCIAL IMPACTS
None, as the property owners paid their fee to process the quitclaim deeds.
COMMITTEE RECOMMENDATION
The Real Estate, Environmental and Planning Committee reviewed this matter at its meeting on November
2, 2020 and recommended Board approval.
RECOMMENDED BOARD ACTION
Adopt the proposed resolution authorizing execution of quitclaim deeds for existing easements to
California Pacific Bank, the Dale L. and Felicidad G. Giberson 2009 Family Trust, or the current property
owners at that time of recording the quitclaim deeds, for properties known as Seclusion Valley located in
the unincorporated area of Lafayette, related to Job 6619, and authorizing staff to record documents with
the Contra Costa County Recorder.

DALE L. AND FELICIDAD G. GIBERSON FAMILY TRUST, OR THE CURRENT
PROPERTY OWNERS AT THE TIME OF RECORDING THE QUITCLAIM DEEDS
AS RELATED TO JOB 6619
BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary
District (Central San) as follows:
THAT Central San hereby authorizes execution of Quitclaim Deeds, listed on Exhibit A
and shown on the attached vicinity map and quitclaim deed exhibit; and
THAT the President of the Board of Directors and the Secretary of the District are
hereby authorized to execute said documents for and on behalf of Central San; and
THAT staff is authorized to record this resolution, the above-mentioned map and exhibit,
and said documents with the Contra Costa County Recorder.
