ISSUE
Section 6490 of the Health and Safety Code of the State of California provides that District ordinances
shall be published once in a newspaper of general circulation within the District, and provides that an Order
of the Board of Directors of the District to the effect that the ordinance has been published shall constitute
conclusive evidence that publication has been properly made.
BACKGROUND
The summaries of uncodified District Ordinance Nos. 312 through 314, which were adopted by the Board
on September 3, 2020, were published in the Contra Costa Times and San Ramon Valley Times on
September 16, 2020.
Each of the ordinances established reimbursement fees for the properties which connect to the Central
San projects and associated Contractual Assessment Districts (CAD) referenced below.
• Ordinance No. 312 - District Project 6603, North Jackson Way CAD No. 2016-2;
• Ordinance No. 313 - District Project 6679, Cordell Drive CAD No. 2017-1; and
• Ordinance No. 314 - District Project 6534, Harper Lane Area CAD No. 2018-1

ALTERNATIVES/CONSIDERATIONS
Confirming publication of the ordinance summaries establishes presumption that the ordinance was
correctly published and therefore would be deemed procedurally valid by a court.
