Bailey Kenton L. Alm General Manager District Counsel ISSUE A resolution of the Board of Directors is required to accept a grant of irrevocable offer of dedication of a sanitary sewer easement to convey real estate property interest to Central San. BACKGROUND Property Owner, Hakam Mission, constructed a public sanitary sewer within a sanitary sewer easement in August 6, 2020 Regular Board Meeting Agenda Packet- Page 60 of 107 Page 2 of 4 the Town of Danville with Job 6505. To provide the necessary land rights to the public sanitary sewer, the property owner recorded a grant of irrevocable offer of dedication (easement for sewer purposes). As the public sanitary sewer was constructed and accepted per Central San's standards, staff recommends the Board accepts this recorded grant of irrevocable offer of dedication of a sanitary sewer easement at this time. ALTERNATIVES/CONSIDERATIONS The Board could decline to accept the offer of dedication of sanitary sewer easements. This alternative is not recommended since Central San would not have the land rights necessary to reconstruct, maintain, or operate the public sanitary sewers that have been accepted from the property owner and are now owned by Central San. FINANCIAL IMPACTS The grant of irrevocable offer of dedication of a sanitary sewer easement was acquired at no cost to Central San. COMMITTEE RECOMMENDATION This item was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Adopt the proposed resolution accepting the Grant of Irrevocable Offer of Dedication of a Sanitary Sewer Easement offered by the Mission Family Trust, as related to Job 6505, located in the Town of Danville, and authorizing staff to record documents with the Contra Costa County Recorder.
