Alm General Manager District Counsel ISSUE August 6, 2020 Regular Board Meeting Agenda Packet- Page 48 of 107 Page 2 of 5 Public hearings and resolutions are required to set and direct that the Fiscal Year 2020-21 assessments be collected on the Contra Costa County tax roll and to establish reimbursement fees for future connectors. BACKGROUND I n the past several years, the Board of Directors (Board) has ordered the construction of sanitary sewer improvements for the North Jackson Way neighborhood in Alamo, a portion of Cordell Drive in Danville, and the Harper Lane neighborhood in Danville. The work to install the improvements has been completed, final costs have been totaled, and final assessments for each participating property can be determined. At its September 3, 2020 meeting, the Board will be requested to conduct a public hearing; confirm and levy these final assessments and to authorize Notices of Assessment; consider placement of charges and assessments on the Contra Costa County tax roll for collection; and establish the reimbursement fees for new connectors to repay participants for covering non-participant costs. After being given an opportunity to pay off their CAD assessment in a lump sum without interest, participating property owners may choose to pay for sewer improvements over a ten-year period at six percent interest. Payments are to be collected by placing assessments on each property owner's tax bill. ALTERNATIVES/CONSIDERATIONS The Board may elect to choose a different date for the public hearings. Public hearings must be held if assessments and charges are to be placed on the County tax roll for collection and CAD participants are to be reimbursed for covering non-participant costs. FINANCIAL IMPACTS None by setting the public hearings. COMMITTEE RECOMMENDATION This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Set three public hearings for September 3, 2020 at 1:30 p.m. to receive comments on confirming and levying final assessments for (1) North Jackson Way CAD No. 2016-2 in Alamo, (2) Cordell Drive CAD No. 2017-1 in Danville, and (2) Harper Lane Area CAD No. 2018-1 in Danville; directing that the Fiscal Year 2020-21 assessments be collected on the Contra Costa County tax roll; and considering adoption of three uncodified ordinances to establish reimbursement fees for the properties which could directly connect to Job 6603 (CAD No. 2016-2), Job 6679 (CAD No. 2017-1), and Job 6534 (CAD No. 2018-1).
