CENTRAL SAN BOARD OF DIRECTORS POSITION PAPER MEETING DATE: MAY 7, 2020 SUBJECT: SET PUBLIC HEARING FOR JUNE 4, 2020, AT 1:30 P.M. TO RECEIVE PUBLIC COMMENT ON: • ADOPTING AN UNCODIFIED ORDINANCE AMENDING THE SCHEDULE OF CAPACITY FEES, AND • ADOPTING AN UNCODIFIED ORDINANCE AMENDING THE SCHEDULE OF ENVIRONMENTAL AND DEVELOPMENT-RELATED FEES AND CHARGES SUBMITTED BY: INITIATING DEPARTMENT: BRYAN MCGLOIN, MANAGMENT ANALYST ENGINEERING AND TECHNICAL SERVICES- THOMAS BRIGHTBILL, SENIOR ENGINEER PDS-RATES AND FEES REVIEWED BY: DANEA GEMMELL, PLANNING AND DEVELOPMENT SERVICES DIVISION MANAGER JEAN-MARC PETIT, DIRECTOR OF ENGINEERING AND TECHNICAL SERVICES Roger S. Bailey General Manager ISSUE State Law and District Code require that a public hearing be held prior to the Board of Directors' consideration of changes to Capacity Fees and Environmental and Development-Related Fees. BACKGROUND Staff has completed its annual review of Central San's Capacity Fees and its annual review of the Environmental and Development-Related Fees and Charges and has concluded that it would be appropriate to revise these fees. The recommended changes to the Capacity Fees account for changes in the value of Central San's assets and changes to the number of Central San customers. The recommended changes to the Environmental and Development-Related Fees and Charges reflect changes to Central San's actual costs to provide these services. May 7, 2020 Regular Board Meeting Agenda Packet- Page 55 of 166 Page 2 of 2 ALTERNATIVES/CONSIDERATIONS The Board of Directors may decline to establish the recommended public hearing date or may elect to choose a different date; however, a public hearing must be held if Capacity Fees and Environmental and Development-Related Fees and Charges are to be revised. Holding the public hearing on June 4, 2020, allows the revised fees to become effective on July 1, 2020. FINANCIAL IMPACTS None by this action. COMMUNITY OUTREACH An outreach program to inform and solicit input from interested customers and stakeholders, including the Building I ndustry Association of the Bay Area, will be conducted by staff before the public hearing on June 4, 2020. COMMITTEE RECOMMENDATION The Finance Committee reviewed staff's proposals for revising these fees and charges at its April 21, 2020 meeting and recommended setting the public hearing. RECOMMENDED BOARD ACTION Establish June 4, 2020, at 1:30 p.m. as the date and time for a public hearing to receive comments on and consider adoption of proposed ordinances to amend the Schedules of Capacity Fees and Environmental and Development-Related Fees.
