BAILEY GENERAL MANAGER ISSUE On March 13, 2020 the General Manager proclaimed a local emergency arising out of the COVI D-19 pandemic. Per the California Emergency Services Act (Government Code Section 8551 et. seq.) the governing body must ratify this proclamation within seven days. BACKGROUND The COVI D-19 virus was first identified in Fall 2019 with cases in China and then migrated to nearby countries. Since then the virus has spread internationally and within the US and CA. Federal, state and county agencies have issued guidelines, recommendations, and now mandates curtailing person-to-person contact including implementation of social distancing measures and self- isolation of people over age 65. Updated directions are coming every day and both public and private entities are activating their pandemic response plans. Central San's Pandemic Response Plan recommends that the General Manager proclaim a local emergency when the County Department of Public Health mandates social distancing measures. The General Manager proclaimed a local emergency on March 13, 2020, the same day that the federal government declared the pandemic as a national emergency. (Attachment 1)A Proclamation of Local Emergency activates all employees as Disaster Service Workers and allows Central San to redeploy personnel as quickly evolving circumstances are warranted. COMMITTEE RECOMMENDATION This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Adopt Resolution 2020-014, in effect ratifying the General Manager's prior action on March 13, 2020 in issuing a Proclamation of Local Emergency arising out of the COVI D-19 pandemic. General Manager's Proclaiming Local Emergency and Federal Declaration of Emergency March 19, 2020 Regular Board Meeting Agenda Packet- Page 41 of 163 AMENDED AGENDA Page 3 of 4 RESOLUTION NO. 2020-014 Resolution Proclaiming the Existence of a Local Emergency WHEREAS, Resolution No. 2020-03 of the Central Contra Costa Sanitary District empowers the Director of Emergency Services to proclaim a Local Emergency when the District is affected or likely to be affected by a public calamity and the Board of Directors is not in session; and WHEREAS, the Director of Emergency Services does hereby find: That conditions of extreme peril to the safety of persons and property have arisen within the District, caused by COVID-19 pandemic (fire, flood, storm, earthquake, epidemic, riot, draught, or other causes); and That these conditions are or are likely to be beyond the control of the services, personnel, equipment and facilities of the District, and: That the Board of Directors of the Central Contra Costa Sanitary District is not in session and cannot immediately be called into session. NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a Local Emergency now exists throughout the District, and: IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said Local Emergency the powers, functions and duties of the emergency organization of this District shall be prescribed by state law, by ordinances and resolutions of this District, and by the Emergency Operations Plan as approved by the Board of Directors on October 7, 2010 and; that this emergency proclamation shall expire in 7 days after issuance unless confirmed and ratified by the Board of Directors of the Central Contra Costa Sanitary District.
