Bailey Kenton L. Alm General Manager District Counsel ISSUE A resolution of the Board of Directors is required to authorize execution of a Quitclaim Deed and to record the documents. BACKGROUND Contra Costa Community College District (College District) is undertaking improvements to their Diablo February 20, 2020 Regular Board Meeting Agenda Packet- Page 76 of 161 Page 2 of 4 Valley College campus and requested to realign a portion of the public sanitary sewer to accommodate a building expansion. Upstream of this public sewer, the College District owns and operates a private site collector system, which meets the definition of a private sewer main since it"serves a single parcel or multiple parcels managed together in perpetuity." Central San staff requested that the College District assume ownership for all existing public sanitary sewer on their parcels that were constructed with Job 1608. The College District did not want to assume the responsibility of the public sewer; however, they agreed to take full ownership of the new realigned sewer. As staff accepted the construction of the abandoned public sewer work, the College District is requesting Central San to quitclaim the portion of the easement that no longer has an active public sewer. ALTERNATIVES/CONSIDERATIONS The Board could decline to quitclaim the portion of the unused easement, although, this action would increase Central San's potential liability for a portion of land without a public sewer. FINANCIAL IMPACTS None. The College District paid their fee to process this quitclaim, as set by District Ordinance No. 307. COMMITTEE RECOMMENDATION This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Adopt the proposed resolution authorizing execution and recording of a Quitclaim Deed for a portion of an existing easement to Contra Costa Community College District for the property known as Diablo Valley College (DVC)- Pleasant Hill Campus.
