G lund J. Mi oto -Mills A. trell James elly, General anager ISSUE: A resolution of the Board of Directors is required to accept easements and record documents. RECOMMENDATION: Adopt a resolution accepting grants of easements and authorizing staff to record the documents with the Contra Costa County Recorder. FINANCIAL IMPACTS: A total of $29,800 was paid for these nine permanent easements obtained for the Martinez Sewer Renovations Project, Phase 3 (DP 5952). ALTERNATIVES /CONSIDERATIONS: None. BACKGROUND: The District installed approximately 5,350 feet of sewer by horizontal directional drilling, pipe - bursting, and open -cut methods as part of the Martinez Sewer Renovations Project, Phase 3 (DP 5952). Since some of the renovation occurred within private properties, staff obtained easement purchase agreements (EPAs) from property owners where additional land rights were necessary to support the project work. The EPAs provided the necessary rights of entry for the construction work and an enforceable commitment from the property owners to grant a permanent easement upon Page 1 of 2 POSITION PAPER Board Meeting Date: November 18, 2010 subject. OWEN, PROPERTY OWNERS, MARTINEZ, AND AUTHORIZING STAFF TO RECORD THE DOCUMENTS (DISTRICT PROJECT 5952 — PARCELS 11, 13 -20 *) completion of the project once the actual sewer alignment was confirmed. These easements are the last and final nine of eighteen new permanent sanitary sewer easements that District received. RECOMMENDED BOARD ACTION: Adopt a resolution accepting grants of easements from Glenn M. Mueller, Jr. and Sharon E.G. Mueller, Helen E. Adams, Owen J. and Candace L. Curtis, Richard V. and Karen E. Bettiga, Martha A. Ammerman, Charles A. Burnash, Jesse E. and Sharon L. Chambers, Nicholas J. Riley and Marcia Kent, and Catherine A. Owen, property owners at 2031 Boynton Avenue, 1311 Bush Street, 1215 Ulfinian Way, 1125 Gregory Avenue, 1135 Gregory Avenue, 1231 Gregory Avenue, 1351 Gregory Avenue, 714 Arlington Way, and 711 Carquinez Way, respectively, Martinez, and authorizing staff to record the documents with the Contra Costa County Recorder.
