Rozul T. PTiecki A. Farrell Parries M. ly, General Manager ISSUE: The Board of Directors' authorization is required to amend consulting agreements beyond staff's authority. RECOMMENDATION: Authorize the General Manager to execute an amendment to an existing technical consulting services agreement. FINANCIAL IMPACTS: The cost ceiling on the existing agreement will be increased by $40,000. ALTERNATIVES /CONSIDERATIONS: Direct staff to self - perform the work, which is not recommended since staff does not possess the experience or laboratory to complete the soils /materials testing as required. BACKGROUND: The City of Walnut Creek's building permit and the California Building Code require that a specialty inspector be present for certain portions of the work such as soil compaction, rebar inspection prior to City inspection, concrete placement, and asphaltic concrete paving installation. The District retained Kleinfelder, Inc. to provide inspection and testing services for the project. Kleinfelder was selected because they possess the necessary experience and laboratory to conduct the analysis. Kleinfelder also reduced the minimum call -out time from four hours to two hours for the project. Staff negotiated a cost reimbursement agreement with Kleinfelder with a not -to- exceed limit of $35,000. This amount was then revised $14,000 by staff for a revised not -to- exceed limit of $49,000. The additional costs are attributed to two factors. The first is that District staff underestimated the amount and degree of inspection and testing for the project. IN THE AMOUNT OF $40,000 FOR THE CONSTRUCTION OF THE CSOD ADMINISTRATION, CREW, AND WAREHOUSE FACILITY, DISTRICT PROJECT NO. 8208 inspection that could not have been anticipated at the award of the project. Staff has negotiated a revision to the agreement limit with Kleinfelder to increase the amount by $40,000, bringing the total agreement amount to $89,000. Staff recommends the continued use of Kleinfelder since they are familiar with the work and have the necessary staff available. The environmental impacts of the CSOD Administration, Crew, and Warehouse Facility were addressed in the Collection System Operations (CSO) Facilities Improvements Project Mitigated Negative Declaration approved by the Board of Directors on December 21, 2007. Subsequently, a Notice of Determination was filed in compliance with the California Environmental Quality Act (CEQA). RECOMMENDED BOARD ACTION: Authorize the General Manager to execute an amendment to an existing technical consulting services agreement with Kleinfelder, Inc. in the amount of $40,000.
