ISSUE: Construction has been completed on the Hall Drive Sewer Renovations,
Phase 213, District Project 5932, and the work is now ready for acceptance.
RECOMMENDATION: Accept the contract work for the Hall Drive Sewer Renovations,
Phase 2B, District Project 5932, and authorize filing of the Notice of Completion.
FINANCIAL IMPACTS: None related to this action.
ALTERNATIVES /CONSIDERATIONS: Not applicable. Filing the Notice of Completion
is advisable under the California Civil Code, Section 3093.
BACKGROUND: The project work included installation of 2,175 feet of 6 -inch HDPE
pipe by horizontal directional drilling and pipe- bursting, and rerouting and replumbing
ten house laterals and cleanouts. The work involved trenching, shoring, manhole
installation, and paving. Construction of sewers required close cooperation with
customers and the City of Orinda for site access and restoration.
On May 20, 2010, the Board of Directors authorized the award of a contract for the
construction of the project to McNamara and Smallman Construction, Inc. The Notice
to Proceed was issued on June 24, 2010. The project was constructed with two major
changes. First, an error in the drawings discovered during construction required
reinstalling 380 feet of main line. Changes were made to the design and construction
procedures for future projects to avoid a reoccurrence of this type of error. Second, in
an easement at Camino Encinas, 600 feet of main line was not constructed due to
right -of -way issues. Eminent domain procedures were started for the Camino Encinas
sewer, and. it will be constructed in Summer 2011. The project was substantially
completed on September 17, 2010. The remaining items of work consist of minor
punch -list items, which do not affect the project acceptance.

OF THE NOTICE OF COMPLETION
Immediately upon acceptance, the Contractor is relieved of the duty of maintaining and
protecting the Contract work. Guaranty and warranty periods required by the Contract
and the statutory period for filing of liens and Stop Notices start on the date of
acceptance by the Board of Directors. Final payment to the Contractor is made after
expiration of the statutory period for filing of liens and Stop Notices, provided no liens or
Stop Notices have been filed, and provided the punch -list items have been completed.
The total authorized budget for the project is $1,611,470. The budget includes the cost
of engineering design, construction management and inspection, testing services,
change orders, and contractor services. An accounting of the project costs will be
provided to the Board at the time of project closeout. It is appropriate to accept the
contract work at this time.
RECOMMENDED BOARD ACTION: Accept the contract work for the Hall Drive Sewer
Renovations, Phase 213, District Project 5932, and authorize filing of the Notice of
Completion.
