ISSUE It is the District's practice to hold a public hearing prior to the Board's
consideration of a Final Environmental Impact Report (EIR).
RECOMMENDATION Set October 7, 2010 at 2:00 p.m. as the date and time for a
public hearing to receive comments on the District Annexation 168C — Alhambra Valley
Final EIR.

BACKGROUND On July 19, 2010, CCCSD distributed for public review a Draft EIR
for District Annexation 168C — Alhambra Valley. CCCSD proposes to annex into its
service area nine Alhambra Valley parcels totaling 92.6 acres. Annexation would allow
for sewer installation and connection of individual residences in the project area. The
proposed annexation is comprised of parcels located outside the County's Urban Limit
Line (ULL). All of the proposed DA 168C properties have been within CCCSD's Sphere
of Influence for several decades. The County General Plan "generally discourages"
urban services outside the ULL, though it does not prohibit them. While Contra Costa
LAFCO is allowed to annex properties that are outside the ULL to service districts (such
as CCCSD) and CCCSD is not prohibited from serving such properties, the proposed
annexation is controversial and needed to be addressed in an EIR.
On August 18, 2010, staff held a community meeting to give the property owners,
residents and other concerned citizens an opportunity to ask questions and express
concerns about the Draft EIR and the proposed annexation. Ten (10) people attended,
some favoring and some opposing the annexation proposal.
The public comment period ends on September 3, 2010. The one comment letter
received to date are from Contra Costa Water District contains relatively minor
comments that will be responded to in the Final EIR.

(DA) 168C — ALHAMBRA VALLEY FINAL EIR
At its October 7, 2010 meeting, the Board of Directors will be requested to certify the
Final EIR prior to approving the proposed annexation. It is customary to hold a public
hearing to receive public comments on the Final EIR and the project during the Board
Meeting at which the Final EIR is presented. After the public hearing, the Board will
consider certifying the Final EIR as an adequate evaluation of the project's
environmental impacts and adopting associated findings as required by the California
Environmental Quality Act (CEQA). If it decides to certify the EIR, the Board may
consider approval of the project or one of its alternatives.

time for a public hearing to receive comments on the District Annexation 168C —
Alhambra Valley Final EIR.
