BAILEY, GENERAL MANAGER SUBJECT: RECEIVE REPORT ONA BUSINESS IN SIGNIFICANT NONCOMPLIANCE DURING 2019 UNDER THE ENVIRONMENTAL COMPLIANCE PROGRAM BACKGROUND Federal pretreatment regulations require Central San to report businesses permitted under the Environmental Compliance Program as a Significant Industrial User (SIU) if they are issued a Notice of Violation during the calendar year. The regulations also establish criteria for agencies such as Central San to use to determine if the violations of a permitted business are classified as Significant Noncompliance (SNC). If a business is determined to be in SNC, Central San is required to publish certain information about the violation in the newspaper at least annually. In 2005, Environmental Compliance staff initiated a program, at the Board's request, to work more closely with the regulated businesses to understand the actions they could take to minimize the events where they would meet the SNC criteria. This program has been very successful and the number of businesses reported in SNC has been significantly reduced. This year, the program assisted two SI Us to return to compliance for potential SNC violations. BUSINESSES IN SNC FOR 2019 One business was determined to meet the SNC criteria during calendar year 2019. • San Ramon Regional Medical Center for submitting a required report more than 45 days after the due date. The information that will be published in the Contra Costa Times is included in the attached document. Publication of Business in SNC during 2019 January 16, 2020 Regular Board Meeting Agenda Packet- Page 134 of 232 Page 3 of 3 PUBLIC NOTICE CENTRAL CONTRA COSTA SANITARY DISTRICT NOTICE OF SIGNIFICANT NONCOMPLIANCE FOR 2019 Notice is hereby given that pursuant to the federal regulations contained in 40 CFR 403.8.f(2)(vii), Central Contra Costa Sanitary District (Central San) is required to publish the names of all Industrial Users (IU) of Central San's public sewer system that were determined to be in significant noncompliance (SNC) with applicable pretreatment standards or other pretreatment requirements during the 2019 calendar year. Federal regulations establish objective criteria for Central San to use to determine if an IU is in SNC. Discharge Quality Violations No IUs were found to have discharged process wastewater in violation of Central San's Local Discharge Limits in a manner that met the definition of SNC. Reporting Violations The following IU was found to be in violation of the reporting requirements of Central San's Environmental Compliance Program in a manner that met the definition of SNC. Industrial User Nature of Violation Follow-up Action Taken San Ramon Regional Periodic Compliance Reports Central San issued Notices of Violation Medical Center (PCR) submitted after the due (NOV)for each violation. The IU submitted 6001 Norris Canyon Road dates. One report was the late PCRs.
