CENTRAL SAN BOARD OF DIRECTORS POSITION PAPER MEETING DATE: NOVEMBER 21, 2019 SUBJECT: APPROVE PROPOSED SALARYAND OTHER ADJUSTMENTS FOR SECRETARY OF THE DISTRICT KATHERI NE YOUNG AS SET FORTH I N THE THI RD AMENDMENT TO HER FEBRUARY 11, 2018 EMPLOYMENT AGREEMENT, EFFECTIVE NOVEMBER 7, 2019 SUBMITTED BY: INITIATING DEPARTMENT: TEJI O'MALLEY, HUMAN RESOURCES OPERATIONS - POD - HUMAN RESOURCES MANAGER REVIEWED BY: ANN SASAKI, DEPUTY GENERAL MANAGER ISSUE Board approval is required to amend the Secretary of the District's employment agreement. BACKGROUND The employment agreement between the District and Secretary of the District Katherine Young allows for the Board to consider an adjustment to her salary or benefits in such amounts and to such extent as the Board may determine is desirable. The Board evaluated Ms. Young's performance as well as salaries and benefits of comparable positions within the relative labor market and determined two adjustments are warranted. It is proposed that, effective November 7, 2019, Ms. Young's annual salary be increased from $138,000 to $144,900, which reflects an increase of five percent; and her Paid Time Off (PTO) be increased from twenty-five (25) days to thirty (30) days per year, with a maximum accumulation of sixty (60) rather than fifty (50) days. All other provisions of the employment contract, as amended, would remain unchanged. ALTERNATIVES/CONSIDERATIONS Deny the adjustments for Ms. Young or propose an alternative change. FINANCIAL IMPACTS Ms. Young's annual salary will increase from $138,000 to $144,900, resulting in an annual cost of$8,177, which includes salary as well as any incremental costs in benefits. RECOMMENDED BOARD ACTION Approve the proposed salary and other adjustments for Secretary of the District Katherine Young as set forth in the Third Amendment to her current Employment Agreement, effective November 7, 2019. Proposed Secretary of the District Employment Amendment (Strikeout) November 21, 2019 Regular Board Meeting Agenda Packet- Page 54 of 91 Page 3 of 3 THIRD D AMENDMENT TO EMPLOYMENT AGREEMENT This Third Seeen Amendment to the current Employment Agreement dated February 11, 2018 between the Central Contra Costa Sanitary District ("District"), a special district organized pursuant to the California Sanitary District Act of 1923, and Katherine Young ("Secretary of the District")is entered pursuant to paragraph XI of that Agreement. The Secretary of the District and the District are hereinafter collectively referred to as "the Parties." This Amendment to the Employment Agreement between the Parties contains amendments to the following provisions of that Agreement: Paragraph V. Salary and Benefits. Effective November 7, 2019 Deeember- 18, 2018, the District shall increase the Secretary of the District's annual salary from$138,000131R to$144,900 438,990mm"y,which reflects an increase of 5.0.447%. Effective November 7,2019,the District shall increase the Paid Time Off(PTO) of twenty- five(25)days per year to thirty(30)days per year and increase the maximum accumulation from fifty (50) days to sixty (60) days. The remaining provisions of paragraph V of the Employment Agreement remain unchanged. Except as expressly stated in this Third Seeon Amendment, all other provisions of the current Employment Agreement remain in full force and effect. This Third Seeen Amendment represents all of the agreements between the parties related to this Third Seeend Amendment,and this may only be modified or amended by an instrument in writing executed by both parties.
