Bailey Kenton L. Alm General Manager District Counsel ISSUE Past practice has been that Board approval is required to enter into long-term property leases. BACKGROUND Since 1994, Central San has had leased rights from the State Lands Commission for the operation, use, and maintenance of sewer pipes crossing Grayson Creek, adjacent to Central San's plant, as shown on the attached location map. The term of that lease has expired and the State Lands Commission requests October 17, 2019 Regular Board Meeting Agenda Packet- Page 21 of 82 Page 2 of 4 that Central San enter into a new lease for Public Agency Use of Sovereign Land for a term of 25 years expiring March 7, 2044. ALT ERNAT IVES/CONSIDERAT IONS The Board could decline to approve the lease. This would result in Central San not being in compliance with the State Lands Commission for its pipes crossing Grayson Creek. FINANCIAL IMPACTS The application processing fee of $3,000 plus a $25 filing fee has been paid to cover the State Lands Commission's administrative costs in reviewing and renewing this lease. Central San will also reimburse the State Lands Commission for any future costs associated with compliance and engineering review. There will be no annual rent for the property as it is considered a public benefit. COMMITTEE RECOMMENDATION This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Adopt a resolution authorizing the General Manager to execute a new 25-year lease agreement with the State Lands Commission at the Grayson Creek crossing. N Map Created On:10/9/2019 Map Projection:WGS84 Central San Map Page 4 of 4 Attachment 2 RESOLUTION NO. 2019-068 A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT AUTHORIZING THE GENERAL MANAGER TO EXECUTE A TWENTY-FIVE-YEAR LEASE WITH THE STATE LANDS COMMISION FOR PIPES CROSSING GRAYSON CREEK IN MARTINEZ BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (Central San) as follows: THAT Central San hereby authorizes the General Manager to execute a lease with the State Lands Commission for Central San's pipes crossing Grayson Creek located in Martinez; and THAT staff is authorized to record the document in the office of the Recorder of Contra Costa County.
