Alm General Manager District Counsel ISSUE A resolution of the Board of Directors is required to accept offers of dedication of sanitary sewer easements as depicted on subdivision maps and to accept grants of irrevocable offers of dedication (I OD) of sanitary sewer easements that convey real estate property interest to Central San and a resolution is required to authorize execution of quitclaim deeds to relinquish Central San's real estate property interest in lands with no public sewers. September 5, 2019 Regular Board Meeting Agenda Packet- Page 153 of 201 Page 2 of 3 BACKGROUND With Job 6598, located in Pleasant Hill, the Developer, Camino Ramon Associates, LLC, a California Limited Liability Company, constructed public sanitary sewers within sanitary sewer easements (sewer easements). To provide the necessary land rights to the public sanitary sewers the Developer offered to Central San sewer easements on a Final Map that was filed with the Contra Costa County Recorder and also offered sewer easements from a recorded I OD. With this job, the Developer abandoned a portion of public sewer that was no longer necessary and a quitclaim deed will relinquish Central San's land rights at this location. ALTERNATIVES/CONSIDERATIONS For the new sewer easements, the Board could decline to accept the offer of dedication; however this alternative is not recommended since Central San would not have the land rights necessary to reconstruct, maintain or operate the public sanitary sewers that have been accepted from the Developer and are now owned by Central San. For the vacation of land rights, the Board could decline to execute the quitclaim deed; however, this alternative is not recommended as Central San would retain land rights on a parcel that does not have a public sewer. FINANCIAL IMPACTS The offers of dedication of sanitary sewer easements, as depicted on said subdivision map and from the recorded I OD, were acquired at no cost to Central San and the Developer paid for the preparation and processing of the quitclaim deed. COMMITTEE RECOMMENDATION This item was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Adopt a resolution (1) accepting the offer of dedication of a sewer easement as depicted on Subdivision Map 9075; (2) accepting a Grant of I rrevocable Offer of Dedication of a sanitary sewer easement; and (3) authorizing execution of a quitclaim deed as stated in the attached proposed resolution. Proposed Resolution September 5, 2019 Regular Board Meeting Agenda Packet- Page 154 of 201 Page 3 of 3 RESOLUTION NO. 2019- A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT ACCEPTING OFFERS OF DEDICATION OF SANITARY SEWER EASEMENTS AS DEPICTED ON SUBDIVISION MAP 9075 AND FROM IRREVOCABLE OFFER OF DEDICATION; AND AUTHORIZE EXECUTION OF A QUITCLAIM DEED, AS RELATED TO JOB 6598 BE IT RESOLVED by the Board of Directors of Central Contra Costa Sanitary District (Central San) as follows: THAT Central San hereby accepts the sanitary sewer easements offered from a subdivision map, titled "Subdivision 9075" and this map was filed on August 28, 2015 in Book 525 of Maps at Page 26 with Contra Costa County Recorder; and THAT Central San hereby accepts the sanitary sewer easements from Grant of Irrevocable Offer of Dedication recorded on March 8, 2017 as Document Series 2017-0041540 with Contra Costa County Recorder; and THAT Central San hereby authorizes the execution of a document titled "Quitclaim Deed — Easement, APN 150-161-073", to Kevin and Kristine Baldacci or to the current property owner(s) at the time of recording this resolution; and THAT staff is authorized to record the documents with the Contra Costa County Recorder.
