Housen and Associates (currently negotiating) Al BACKGROUND ON RETENTION California Public Contract Code Section 7201 Change maximum retention from 10% to 5% Code change effective Jan. 2012, renewed in 2017, until 2023. Central San Board has increased the retention on three prior projects. IN 4 CENTRAL SAN PROJECTS THAT INCREASED RETENTION DUE TO COMPLEXITY HOB Seismic Project in 2012 — 10% retention held — Successful in resolving issues with steel and welding subcontractors Primary Renovation Project in 2013 — 10% retention held — Early release due to good performance by General Contractor and subcontractors Headworks Screenings Upgrade Project in 2016 — 10% retention held — Successful in resolving issues with equipment vendor and electrical subcontractor CENTRAL SAN FAIR RETENTION PRACTICES WITH CONTRACTORS AND SUBCONTRACTORS • Better to hold retainage than having to hold payments — Less impacts on cash flow Can help resolve stop notices: Issue of two- party checks to pay subcontractor. E.g.; SCB Roofing project Stop notices and punch list completeness, releases from vendor, suppliers, subcontractors Partial release to subcontactors for early activities. E.g.; excavator 5 RECOMMENDED BOARD ACTIONS Conduct public hearing to consider adopting Resolution No. 2019-041 finding that, in accordance with California Public Contract Code Section 7201, the Pump Station Upgrades - Phase 1, District Project 8436, is substantially complex to justify increasing the construction contract retention amount from 5% to 10% den1 ,1 QUESTIONS? 6
