Bailey General Manager ISSUE Section 6490 of the Health and Safety Code of the State of California provides that District ordinances shall be published once in a newspaper of general circulation within the District, and provides that an Order of the Board of Directors of the District to the effect that the ordinance has been published shall constitute conclusive evidence that publication has been properly made. BACKGROUND Summaries of uncodified District Ordinance Nos. 304 and 305, which were adopted by the Board on April 18, 2019, were published in the Contra Costa Times and San Ramon Valley Times on June 10, 2019. Summaries of uncodified District Ordinance Nos. 306 and 307, which were adopted by the Board on June 6, 2019, were published in the Contra Costa Times and San Ramon Valley Times on June 17, 2019. Below are descriptions of these ordinances: • No. 304 —Adopted a Schedule of Sewer Service Charges for the next four years • No. 305 —Adopted an updated Schedule of Recycled Water Charges for the next four years • No. 306 —Adopted an updated Schedule of Capacity Fees, Rates and Charges for Fiscal Year 2019-20 • No. 307 —Adopted an updated Schedule of Environmental and Development-Related Fees and Charges for Fiscal Year 2019-20 July 11, 2019 Special Board Meeting Agenda Packet- Page 56 of 241 Page 2 of 10 ALTERNATIVES/CONSIDERATIONS Confirming publication of the ordinance summaries establishes presumption that the ordinances were correctly published and therefore would be deemed procedurally valid by a court.
