CENTRAL SAN BOARD OF DIRECTORS POSITION PAPER MEETING DATE: JUNE 20, 2019 SUBJECT: ADOPT RESOLUTION 2019-035AUTHORIZING THE GENERAL MANAGER TO EXECUTE A FIVE-YEAR LEASE WITH CALTRANS FOR CENTRAL SAN'S USE OF THE PROPERTY LOCATED OFF OF IMHOFF DRIVE IN MARTI NEZ SUBMITTED BY: INITIATING DEPARTMENT: DAVID KRAMER, SENIOR RIGHT OF WAY ENGINEERING AND TECHNICAL SERVICES - AGENT PDS - DEVELOPMENT SERVICES - RIGHT OF WAY REVIEWED BY: DANA LAWSON, SENIOR ENGINEER DANEA GEMMELL, PLANNING AND DEVELOPMENT SERVICES DIVISION MANAGER JEAN-MARC PETIT, DIRECTOR OF ENGINEERING AND TECHNICAL SERVICES Roger S. Bailey General Manager ISSUE Past practice has been that Board approval is required to enter into long-term property leases. BACKGROUND Since 2005, Central San has leased the buffer property along Imhoff Drive (as shown on the attached map)from Caltrans to ensure that Central San maintains control of how the property is used. The term of the original lease has expired and the parties are currently operating on a month-to-month basis. Caltrans is requesting that Central San renew the lease by entering into a new five-year lease agreement. June 20, 2019 Regular Board Meeting Agenda Packet- Page 35 of 120 Page 2 of 4 ALTERNATIVES/CONSIDERATIONS The Board could reject the lease. This could result in Caltrans leasing to another party to which Central San would have no control over the use of the property. FINANCIAL IMPACTS Annual rent for the property will be $3,050 and a $2,400 deposit is required. COMMITTEE RECOMMENDATION This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Adopt the proposed resolution authorizing the General Manager to execute a five-year lease with Caltrans for Central San's use of the property located off of Imhoff Drive in Martinez, as shown on the attached map.
