ISSUE
Participation in the CalPERS Health Plans, which are governed by the Public Employees' Medical and
Hospital Care Act (PEMHCA), require the Board of Directors to adopt resolutions before the transition to
CalPERS can be effective.
BACKGROUND
In late 2018, the Board of Directors adopted Memoranda of Understanding (MOUs)with all three of its
bargaining units: Public Employees Union Local #1, Management Support/Confidential Group, and the
Management Group. As part of negotiations, the District and the bargaining units agreed to transition from
the District's current medical plans to CalPERS health plans, effective July 1, 2019. This change will
impact all current employees, including members of the Board of Directors, as well as District retirees.
Pursuant to Government Code 22892, all participating agencies would become subject to the regulations
set forth in PEMHCA as follows:
The employer contribution towards the health care for active employees and retirees of a contracting
agency shall begin on the effective date of enrollment and shall be the amount fixed from time to time by
resolution of the governing body of the agency.

The employer contribution for active employees and retirees must be equal but each agency has the
discretion to establish a lesser employer contribution for retirees than for active employees, provided that
the monthly contribution for retirees is annually increased to equal an amount not less than the number of
years the agency has participated in CalPERS multiplied by 5% of the current monthly employer
contribution for active employees until the time that the employer contribution for retirees equals the
employer contribution paid for employees. The first year of participation in CalPERS requires a minimum
contribution of$136.00 (minimum set forth by CalPERS and adjusted each calendar year by increases in
the Consumer Price Index)for active employees and a minimum of$1.00 for retirees.
The District has elected to set the employer contribution at the minimum levels required to participate in
CalPERS. The District will contribute $136.00 a month for each active employee and $1.00 a month for
each retiree for calendar year 2019. These amounts will increase every year that the District participates in
CalPERS. The minimum for active employees is adjusted annually by changes in the medical care
component of the Consumer Price I ndex-Urban, and the retiree contribution is adjusted each year by 5%
of the active employee contribution added to the previous year's retiree contribution until they are the same
for both actives and retirees, which would happen in 20 years.
The District's actual contributions will be made in accordance with the MOUs, which exceed the
aforementioned minimum amounts. Any changes to the District's contributions for active employees is
subject to bargaining.
Employees and retirees may choose any plan that CalPERS offers; however, the District will only pay up
to 100% of the premium rate for Kaiser Permanente or Health Net Smart Care, whichever is higher, for
employees and retirees under the age of 65. For retirees over the age of 65, the District will pay up to
100% of the premium rate for Kaiser Senior Advantage or United Healthcare. If an employee or retiree
chooses a plan that exceeds these amounts, they shall pay the difference to the District. Retirees, both
current and future, shall continue to reimburse the District for any premium amounts as detailed in the
MO Us at time of retirement based upon their Tier at the time of hire.
Additionally, to continue providing benefits for surviving dependents of District employees and retirees, the
Board must also adopt resolutions before those benefits can be offered. The level of benefits granted to a
surviving dependent will be at the same level of the deceased employee or retiree for the life of the
dependent.
The attached proposed resolutions (Attachments 1-15) are specific to each of the five bargaining units
and/or employee groups:
1. Elected Officials;
2. Management Group;
3. Management Support/Confidential Group;
4. Public Employees Union Local #1; and
5. Unrepresented employees, or those covered by an employment contract.
There are three proposed resolutions for each group specifying the following:
1. Employer contributions;
2. Survivor benefits for deceased employees; and
3. Survivor benefits for retirees.

ALT ERNAT IVES/CONSIDERAT IONS
As this item has been negotiated with the District's bargaining units, not approving this action would be in
violation of the MO Us already approved by the Board in 2018.
FINANCIAL IMPACTS
Upon approval, this action will result in a cost savings of$5.8 million for Fiscal Year 2019-20. Future
similar cost savings are anticipated as Central San continues to participate in CalPERS. Cost savings
reflect the premium savings for both active employees and retirees.
COMMITTEE RECOMMENDATION
The Administration Committee reviewed this item during their March 12, 2019 meeting and recommended
adoption of the proposed resolutions.
RECOMMENDED BOARD ACTION
Adopt the proposed resolutions so that the District may proceed with the transition to CalPERS Health
Plans.

ELECTING TO BE SUBJECT TO THE PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL
CARE ACT AT UNEQUAL AMOUNTS FOR EMPLOYEES AND ANNUITANTS WITH
RESPECT TO A RECOGNIZED EMPLOYEE ORGANIZATION
(NON PERS) Elected Officials
WHEREAS, (1) A contracting agency meeting the eligibility requirements set forth in
Government Code Section 22920, may obtain health benefit plan(s), as
defined under Government Code Section 22777, by submitting a resolution
to the Board of Administration of the California Public Employees'
Retirement System (the"Board"), and upon approval of such resolution by
the Board, become subject to the Public Employees' Medical and Hospital
Care Act (the "Act"); and
WHEREAS, (2) Central Contra Costa Sanitary District is a contracting agency eligible to be
subject to the Act under Government Code Section 22920; and
WHEREAS, (3) Government Code Section 22892(a) provides that a contracting agency
subject to Act shall fix the amount of the employer contribution by resolution;
and
WHEREAS, (4) Government Code Section 22892(b) provides that the employer contribution
shall be an equal amount for both employees and annuitants, but may not
be less than the amount prescribed by Section 22892(b) of the Act; and
WHEREAS, (5) Government Code Section 22892(c) provides that, notwithstanding Section
22892(b), a contracting agency may establish a lesser monthly employer
contribution for annuitants than for employees, provided that the monthly
employer contribution for annuitants is annually increased to equal an
amount not less than the number of years the contracting agency has been
subject to this subdivision multiplied by 5 percent of the current monthly
employer contribution for employees, until the time that the employer
contribution for annuitants equals the employer contribution paid for
employees; and
WHEREAS, (6) Central Contra Costa Sanitary District desires to obtain for its employees
and annuitants who are members of(NON PERS) Elected Officials the
benefit of the Act and to accept the liabilities and obligations of an employer
under the Act; NOW, THEREFORE, BE IT
RESOLVED, (a) Central Contra Costa Sanitary District elects to be subject to the provisions
of the Act; and be it further
RESOLVED, (b) That the employer contribution for each employee shall be the amount
necessary to pay the full cost of his/her enrollment, including the enrollment
of family members, in a health benefits plan up to a maximum of the
PEMHCA Minimum per month, and be it further
RESOLVED, (c) That the employer contribution for each annuitant shall be the amount
necessary to pay the full cost of his/her enrollment, including the enrollment

RESOLVED, (d) That the monthly employer contribution for annuitants is annually increased
to equal an amount not less than the number of years the contracting
agency has been subject to this subdivision multiplied by 5 percent of the
current monthly employer contribution for employees, until the time that the
employer contribution for annuitants equals the employer contribution paid
for employees;
And that the contributions for employees and annuitants shall be in addition
to those amounts contributed by the Public Agency for administrative fees
and to the Contingency Reserve Fund; and be it further
RESOLVED, (e) Central Contra Costa Sanitary District has fully complied with any and all
applicable provisions of Government Code Section 7507 in electing the
benefits set forth above; and be it further
RESOLVED, (f) That the participation of the employees and annuitants of Central Contra
Costa Sanitary District shall be subject to determination of its status as an
"agency or instrumentality of the state or political subdivision of a State" that
is eligible to participate in a governmental plan within the meaning of
Section 414(d) of the Internal Revenue Code, upon publication of final
Regulations pursuant to such Section. If it is determined that Central Contra
Costa Sanitary District would not qualify as an agency or instrumentality of
the state or political subdivision of a State under such final Regulations,
CalPERS may be obligated, and reserves the right to terminate the health
coverage of all participants of the employer; and be it further
RESOLVED, (g) That the executive body appoint and direct, and it does hereby appoint and
direct, Teji O'Malley, Human Resources Manager to file with the Board a
verified copy of this resolution, and to perform on behalf of Central Contra
Costa Sanitary District all functions required of it under the Act; and be it
further
RESOLVED, (h) That coverage under the Act be effective on July 1, 2019.

RESPECT TO A RECOGNIZED EMPLOYEE ORGANIZATION
(NON PERS) Unrepresented Group
WHEREAS, (1) A contracting agency meeting the eligibility requirements set forth in
Government Code Section 22920, may obtain health benefit plan(s), as
defined under Government Code Section 22777, by submitting a resolution
to the Board of Administration of the California Public Employees'
Retirement System (the"Board"), and upon approval of such resolution by
the Board, become subject to the Public Employees' Medical and Hospital
Care Act (the "Act"); and
WHEREAS, (2) Central Contra Costa Sanitary District is a contracting agency eligible to be
subject to the Act under Government Code Section 22920; and
WHEREAS, (3) Government Code Section 22892(a) provides that a contracting agency
subject to Act shall fix the amount of the employer contribution by resolution;
and
WHEREAS, (4) Government Code Section 22892(b) provides that the employer contribution
shall be an equal amount for both employees and annuitants, but may not
be less than the amount prescribed by Section 22892(b) of the Act; and
WHEREAS, (5) Government Code Section 22892(c) provides that, notwithstanding Section
22892(b), a contracting agency may establish a lesser monthly employer
contribution for annuitants than for employees, provided that the monthly
employer contribution for annuitants is annually increased to equal an
amount not less than the number of years the contracting agency has been
subject to this subdivision multiplied by 5 percent of the current monthly
employer contribution for employees, until the time that the employer
contribution for annuitants equals the employer contribution paid for
employees; and
WHEREAS, (6) Central Contra Costa Sanitary District desires to obtain for its employees
and annuitants who are members of(NON PERS) Unrepresented Group
the benefit of the Act and to accept the liabilities and obligations of an
employer under the Act; NOW, THEREFORE, BE IT
RESOLVED, (a) Central Contra Costa Sanitary District elects to be subject to the provisions
of the Act; and be it further
RESOLVED, (b) That the employer contribution for each employee shall be the amount
necessary to pay the full cost of his/her enrollment, including the enrollment
of family members, in a health benefits plan up to a maximum of the

(NON PERS) Elected Officials
WHEREAS, (1) A contracting agency meeting the eligibility requirements set forth in
Government Code Section 22920, may obtain health benefit plan(s), as
defined under Government Code Section 22777, by submitting a resolution
to the Board of Administration of the California Public Employees'
Retirement System (the"Board"), and upon approval of such resolution by
the Board, become subject to the Public Employees' Medical and Hospital
Care Act (the "Act"); and
WHEREAS, (2) Central Contra Costa Sanitary District is a contracting agency eligible to be
subject to the Act under Government Code Section 22920; and
WHEREAS, (3) Government Code Section 22819.1 permits a contracting agency subject to
the Act to provide benefits to family members of a deceased annuitant who
does not receive an allowance in place of the annuitant, upon proper
application; NOW, THEREFORE, BE IT
RESOLVED, (a) Central Contra Costa Sanitary District desires to obtain for members of the
(NON PERS) Elected Officials the benefit of Section 22819.1 and accepts
the liabilities and obligations of a contracting agency under the Section; and
be it further
RESOLVED, (b) Central Contra Costa Sanitary District elects to be subject to the provisions
of Section 22819.1 of the Government Code; and be it further
RESOLVED, (c) That the participation of the employees and annuitants of Central Contra
Costa Sanitary District shall be subject to determination of its status as an
"agency or instrumentality of the state or political subdivision of a State" that
is eligible to participate in a governmental plan within the meaning of
Section 414(d) of the Internal Revenue Code, upon publication of final
Regulations pursuant to such Section. If it is determined that Central Contra
Costa Sanitary District would not qualify as an agency or instrumentality of
the state or political subdivision of a State under such final Regulations,
CalPERS may be obligated, and reserves the right to terminate the health
coverage of all participants of the employer; and be it further
RESOLVED, (d) That the executive body appoint and direct, and it does hereby appoint and
direct, Teji O'Malley, Human Resources Manager to file with the Board a
verified copy of this resolution, and to perform on behalf of Central Contra
Costa Sanitary District all functions required of it under the Act.

REQUIREMENT TO ADOPT RESOLUTIONS
• To participate in CalPERS, an agency
must adopt a resolution that details the
mandatory active employee and retiree
contributions, as well as any survivor
benefits.
• The resolutions being recommended for
adoption are the minimums required for
participation in CalPERS.

RESOLUTIONS
• Mandatory Employer Contributions: The contributions for active
employees and retirees can be different but must be at least the
Public Employees' Medical and Hospital Care Act (PEMHCA)
minimum.
• Mandatory Contributions for active employees are adjusted
every calendar year based on changes in Consumer Price Index
(CPI). The amount for calendar year 2019 is$136 per month.
• Mandatory Contributions for retirees start at$1 per month and
are adjusted each year by 5% of the active employee
contribution until they are the same for both active employees
and retirees, which would happen in 20 years.
• Survivor Benefits: The level of benefits granted to a surviving
dependent will be at the same level of the deceased employee or
retiree for the life of the dependent.
