CENTRAL SAN CENTRAL SAN BOARD OF DIRECTORS POSITION PAPER MEETING DATE: DECEMBER 20, 2018 SUBJECT: APPROVE SALARY ADJUSTMENT FOR SECRETARY OF THE DISTRICT KATHERINE YOUNG AND THE SECOND AMENDMENT TO THE FEBRUARY 11, 2018 EMPLOYMENT AGREEMENT, EFFECTIVE DECEMBER 18, 2018 SUBMITTED BY: INITIATING DEPARTMENT: TEJI O'MALLEY, HUMAN RESOURCES OPERATIONS - POD - HUMAN RESOURCES MANAGER REVIEWED BY: ANN SASAKI, DEPUTY GENERAL MANAGER ISSUE Board approval is required to amend the Secretary of the District's employment agreement. BACKGROUND The employment contract between the District and Ms. Katherine Young allows for the Board to consider an adjustment to her salary in such amounts and to such extent as the Board may determine is desirable based upon her performance. The Board evaluated Ms. Young's performance and determined a salary adjustment is warranted based upon her performance. It is proposed that, effective December 18, 2018, Ms. Young's annual salary be increased from $131,282 to $138,000 annually, which reflects an increase of 5.117%. All other provisions of the employment contract would remain unchanged. ALTERNATIVES/CONSIDERATIONS Deny the salary adjustment for Ms. Young or propose an alternative adjustment. FINANCIAL IMPACTS Ms. Young's annual salary will increase from $131,282 to $138,000, resulting in an annual cost of$7,961, December 20, 2018 Regular Board Meeting Agenda Packet- Page 103 of 168 Page 2 of 3 which includes salary as well as any incremental costs in benefits. COMMITTEE RECOMMENDATION This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Approve the salary adjustment for Secretary of the District Katherine Young and the Second Amendment to the February 11, 2018 Employment Agreement, effective December 18, 2018. Proposed Second Amendment to Employment Agreement December 20, 2018 Regular Board Meeting Agenda Packet- Page 104 of 168 Page 3 of 3 SECOND AMENDMENT TO EMPLOYMENT AGREEMENT This Second Amendment to the current Employment Agreement dated February 11, 2018 between the Central Contra Costa Sanitary District ("District"), a special district organized pursuant to the California Sanitary District Act of 1923, and Katherine Young ("Secretary of the District") is entered pursuant to paragraph XI of that Agreement. The Secretary of the District and the District are hereinafter collectively referred to as "the Parties." This Amendment to the Employment Agreement between the Parties contains amendments to the following provisions of that Agreement: Paragraph V.Salary. Effective December 18, 2018, the District shall increase the Secretary of the District's salary from $131,282 to$138,000 annually,which reflects an increase of 5.1171/o.The remaining provisions of paragraph V of the Employment Agreement remain unchanged. Except as expressly stated in this Second Amendment, all other provisions of the current Employment Agreement remain in full force and effect. This Second Amendment represents all of the agreements between the parties related to this Second Amendment,and this may only be modified or amended by an instrument in writing executed by both parties.
