SUBJECT: RECEIVE UPDATE ON THE MOST RECENT MEETING OF THE BAYAREA
CLEAN WATER AGENCIES (BACWA)
The Annual Technical Seminar with the Regional Water Quality Control Board (RWQCB)at Pardee was
on October 25-26, 2018. Below are key topics that were discussed at this meeting and through
committees:
Test of Significant Toxicity -The State Water Board's draft toxicity plan was released on October 19,
2018 for review and comment.A public workshop was held on October 31, 2018 in Sacramento, where
BACWA participated. There will be a hearing on November 28, 2018 in Sacramento, and public
comments are due by December 7, 2018. All POTWs (publicly owned treatment works)that treat more
than 5 mgd/day will be considered to have Reasonable Potential and will be required to test quarterly and
meet effluent limits.Acute Toxicity testing frequency, however, may be reduced to once a year, depending
on regional board determinations.
Nutrients -The fourth Group Annual Report required by the Nutrient Watershed Permit was submitted to
the RWQCB on October 1, 2018. The Group Annual Report presents nutrient effluent monitoring data
reported to BACWA and also provides an analysis of nutrient trends. For the most part, bay-wide, the
flows and loads for the most recent year of data was lower than the 2016/2017 year, but higher than all
previous years.
BACWA continues to engage with the RWQCB on the approach to the second Watershed Permit for
2019. The RWQCB will be crafting draft language on nutrients for the next permit's fact sheet to describe
load caps for the 2024 permit and any buffers or other accommodation for early actions on nutrient
reductions. BACWA is working closely with the RWQCB on this effort and this was a focus of discussions
at the Pardee Technical Seminar.
HDR and RWQCB staff will present an update on nutrients and the upcoming permit renewal to the
RWQCB on November 14, 2018.
Recycled Water Policy -The State plans to adopt policy amendments in December 2019. BACWA
commented on the May draft and an update from the State is expected soon.

The next BACWA Executive Board Meeting will be held on November 16, 2018.
The Annual Member's Meeting will be on January 11, 2019 at the Scottish Rite Center in
Oakland, CA.
