Alm General Manager District Counsel ISSUE A resolution of the Board of Directors is required to accept a grant of easement for sanitary sewer easements to convey any real estate property interest to Central San and to record the documents with the Contra Costa County Recorder. October 4, 2018 Regular Board Meeting Agenda Packet- Page 84 of 265 Page 2 of 6 BACKGROUND Located in downtown Walnut Creek, Developer, Riviera Family Apartments, L.P., a California limited partnership, planned a family-oriented community known as Riviera Family Apartments that consists of approximately 58 units. This transit-oriented development includes two sites for housing at 1515 and 1738 Riviera Avenue in Walnut Creek. With the 1515 Riviera Avenue Sewer Project, Job 6628M, the Developer installed a public sanitary sewer manhole on an existing public eight-inch sewer main, which is parallel to an existing public 6-inch sewer main. Due to the previous roadway realignment of Riveria Avenue, both of the public sewers, which had been originally installed within the public right of way, are now located on private property owned by the Developer. Although the City of Walnut Creek recorded a sewer easement reservation for these two public sewers, staff requested the Developer to perfect the sewer land rights to Central San's current sanitary sewer easement language. The Developer complied and provided an executed grant of easement. As the public sewer manhole was constructed and accepted per Central San's standards, staff recommends the Board accepts this grant of easement at this time. The Board historically accepts grants of easement by resolution. Upon acceptance and recording of the signed grant of easement and this resolution, Central San will have recorded land rights that match current easement language for reconstruction, maintenance, and operation of this public sewer manhole constructed with Sewer Job 6628M. ALTERNATIVES/CONSIDERATIONS None. FINANCIAL IMPACTS The grant of easement for sewer purposes was acquired at no cost to Central San. COMMITTEE RECOMMENDATION This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Adopt a resolution: (1) accepting the executed grant of easement from Riviera Family Apartments, L.P., a California limited partnership, and (2) authorizing staff to record the executed grant of easement and this resolution with the Contra Costa County Recorder. Project Location October 4, 2018 Regular Board Meeting Agenda Packet- Page 87 of 265 Page 5 of 6 ATTACHMENT 2 RESOLUTION NO. 2018- A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT ACCEPTING A GRANT OF EASEMENT FOR SANITARY SEWER EASEMENTS AS RELATED TO 1515 RIVIERA AVENUE SEWER PROJECT JOB 6628M, LOCATED IN WALNUT CREEK AND AUTHORIZING THE RECORDING OF THE DOCUMENTS WHEREAS, Developer, Riviera Family Apartments, L.P., a California limited partnership, constructed a public sanitary sewer manhole with the 1515 Riviera Avenue Sewer Project, Job 6628M, that is located in the city of Walnut Creek; and WHEREAS, the Developer, who is also the property owner, granted a sanitary sewer easement to Central Contra Costa Sanitary District (Central San) via a document titled "Grant of Easement (Sewer Purposes)", which was executed by the Developer on April 24, 2018; and WHEREAS, the public sewer manhole was constructed and accepted per Central San's standards, staff recommends the Board accepts this grant of easement. BE IT RESOLVED by the Board of Directors of Central San as follows: THAT Central San hereby accepts the easement as stated in said Grant of Easement, which is more specifically referred to as "Grant of Easement (Sewer Purposes) for APN 174-150- 076, ROW Parcel 2 — Job 6628M"; and THAT staff is authorized to record the grant of easement and this resolution with the Contra Costa County Recorder.
