ISSUE
State Law and the Resolution of Intention passed by the Board of Directors on March 1, 2018 require that
a public hearing be held to establish the Harper Lane Area Contractual Assessment District (CAD) No.
2018-1.
BACKGROUND
On March 1, 2018, the Board of Directors adopted a resolution of intention to create the Harper Lane Area
CAD for the purpose of installing sewer improvements on Harper Lane, Pixie Lane, Terry Lane, Harmony
Court, and Bradford Place in Danville. The proposed Harper Lane Area CAD complies with the updated
August 16, 2018 Regular Board Meeting Agenda Packet- Page 13 of 149

CAD policy approved at the February 1, 2018 Board of Directors meeting. Thirty-four properties could be
served by a Harper Lane Area CAD public sewer(see Exhibit A).
As required by the Contractual Assessment chapter of the I mprovement Act of 1911, an Engineer's
Report estimating assessments for properties within the CAD, has been prepared and distributed. It is
now appropriate to schedule a public hearing to offer interested parties the opportunity to comment on the
project, the proposed assessments, and related issues.
While the I mprovement Act of 1911 states that CADs are "voluntary and imposed pursuant to an
agreement with an assessed property owner" and are not subject to the requirements of Proposition 218,
Central San has adopted procedures for CAD formation which follow requirements of Proposition 218 that
are not in conflict with the voluntary nature of a CAD.
ALTERNATIVES/CONSIDERATIONS
The Board of Directors could select a different date for the public hearing, which would delay the CAD
proceedings.
FINANCIAL IMPACTS
There are minor costs for publishing a legal notice advertising the public hearing and for staff preparation
and attendance. These costs will eventually be paid by the CAD participants. Subsequent approval of the
Harper Lane Area CAD would commit Central San to finance up to $782,505 in sewer improvements,
which would be repaid by property owners.
COMMITTEE RECOMMENDATION
The formation of the Harper Lane Area CAD No. 2018-1 was not reviewed by a Board Committee.
RECOMMENDED BOARD ACTION
Set public hearing for October 4, 2018 at 1:30 p.m. to consider establishing Harper Lane Area CAD No.
2018-1 in Danville.
