CENTRAL SAN CENTRAL SAN BOARD OF DIRECTORS POSITION PAPER MEETING DATE: JULY 19, 2018 SUBJECT: CONFIRM PUBLICATION OF SUMMARIES OF UNCODIFIED ORDINANCE NOS. 301 AND 302 ADOPTING UNCODIFIED SCHEDULES OF (1) CAPACITY FEES, RATES AND CHARGES, AND (2) ENVI RONMENTAL AND DEVELOPMENT-RELATED FEES AND CHARGES SUBMITTED BY: INITIATING DEPARTMENT: KATIE YOUNG, SECRETARY OF THE SECRETARYOF THE DISTRICT DISTRICT Roger S. Alm General Manager District Counsel ISSUE Section 6490 of the Health and Safety Code of the State of California provides that District ordinances shall be published once in a newspaper of general circulation within the District, and provides that an Order of the Board of Directors of the District to the effect that the ordinance has been published shall constitute conclusive evidence that publication has been properly made. BACKGROUND Summaries of District Ordinance Nos. 301 and 302, which were adopted by the Board at its meeting on June 7, 2018, were published in the Contra Costa Times and the San Ramon Valley Times on June 22, 2018. Proofs of publication are attached. The Board is being asked to confirm publication of the summaries of the following District Ordinances: July 19, 2018 Regular Board Meeting Agenda Packet- Page 27 of 111 Page 2 of 6 • Ordinance No. 301 -An ordinance adopting an uncodified schedule of capacity fees, rates and charges in accordance with District Code Chapter 6.12, effective July 1, 2018; and • Ordinance No. 302 -An ordinance adopting an uncodified schedule of environmental and development-related fees and charges in accordance with District Code Chapter 6.30, effective July 1, 2018. ALTERNATIVES/CONSIDERATIONS Confirmation of publication of the summaries of Ordinance Nos. 301 and 302 establishes the presumption that the ordinances were correctly published and therefore would be deemed procedurally valid by a court. FINANCIAL IMPACTS None. COMMITTEE RECOMMENDATION This matter was not reviewed by a Board Committee. RECOMMENDED BOARD ACTION Confirm publication of summaries of uncodified District Ordinance Nos. 301 and 302.
