Las Lomitas:
• Subdivision developed in 1949
• Annexed to Central San in 1955
• No formal easement documents
• Right-of-Way issues discussed with Board on April 17,
2008 (Attachment 2)
Collection System Sewer Renovation Phase 1:
Includes Danville, Phase 3:
• Currently in Planning phase
• Las Lomitas sewers scheduled and being evaluated for
near term replacement
• 1,380 feet of sewers (Riverwatch by January 2020)

BENEFITS OF REROUTING LATERALS
Central San Benefits:
• Move away from drainage channel
• Eliminate encroachments on sewers
• Improved access for future cleaning and maintenance
• Less sewers to maintain in the future (1,750 feet less)
Homeowner Benefits:
• Future use of property (home expansion or pool)
• No easement needed and eliminate encroachments
• New lateral
• Central San not performing future maintenance or
repairs in their yards

Background
• Subdivision developed in 1949
• Sewers pumped to neighborhood treatment plant
• Annexed to CCCSD in 1955
• No formal easement documents received at the time.
• In 1977 the Board adopted a resolution declaring that the District has
easement rights "generally affecting all lots..."

Financial Impacts
•Cost of new sewer main
• 2,300 feet of sewer$200 per linear foot- $460,000.
• Number of properties = 50
•Cost of relocated sewer laterals
•Average of 150' at $75 per linear foot for a per lot
estimate of$11,250 (Total $562,500)
•Total cost $1,022,500 or $20,450/lot
•The existing sewers will be TV inspected in the next
few months. If inspection information warrants
action we will discuss with Board.
Easement Issues
• Las Lomitas was not a Local Improvement District, City-owned or
Developer constructed sewer system.
• This annexation was unique and not well documented.
• Property rights of District not clarified at time of annexation.

Current Property Rights Issues
• No recorded grant of easement or formal dedication of property
rights to the District.
• Two main issues:
• Notice to current and future owners and other parties holding property
rights(lenders,other easement owners).
• Obtaining unequivocal legal easement rights.
Easement Notice Issues
• In the 1970's— District provided notice by recording
declaration against subdivision.
• This action has not provided adequate notice through title reports.
• 2008— notice by recording declaration against each parcel.
• Declaration should be reflected in most title reports.
• This action does not create "constructive" legal notice.
• Future notice—could also record declaration in grantee-
grantor index.
• This might increase listings in title reports.
• This action would not create "constructive" legal notice.

Remaining Easement Issues
• Notice issues.
•Actual notice v. "constructive" notice.
•Current owners have actual notice, but not "constructive"
legal notice.
• Notice v. undisputed legal easement rights.
•Actual notice will minimize problems with existing and
new property owners.
•Notice does not create easement rights.
•Must obtain grants of easement or a judgment to perfect
easement rights.
Legal Conclusions
• Existing notices should minimize, but not eliminate, conflicts with
property owners.
• Only means to fully eliminate conflicts over easement rights is to
obtain grants of easement or obtain a judgment.
