Item 6.
Central Contra Costa Sanitary District
April 26, 2018
TO: HONORABLE BOARD OF DIRECTORS
FROM: KATIE YOUNG, SECRETARYOF THE DISTRICT
REVIEWED BY: KENTON L. ALM, DISTRICT COUNSEL
ROGER S. BAILEY, GENERAL MANAGER
SUBJECT: RECEIVE FOLLOW-UP INFORMATION REQUESTED AT MARCH 15, 2018
BOARD MEETING REGARDING PAYMENT OF STIPENDS, AND
CONCLUDE ANNUAL PUBLIC REVIEW OF BOARD MEMBER
COMPENSATION AND BENEFITS
At the March 15, 2018 public hearing for the annual review of the Board compensation and benefits, the
Board unanimously decided to leave Board Member compensation and benefits unchanged pending
receipt at a future meeting of (1)feedback from District Counsel as to the legality of considering Member
Causey's suggestion of a flat monthly fee for meeting compensation and (2) historical information on
payment of stipends.
After discussing the legality of the flat monthly fee for meeting compensation with District Counsel, it has
been confirmed that a flat monthly fee is not allowed under the current statutes. Section 6489 of Health
and Safety Code (H&SC) states that"each of the members of the Board shall receive compensation in an
amount not to exceed one hundred dollars ($100) per day for each day's attendance at meetings of the
board or for each day's service rendered as a director by request of the board, not exceeding a total of six
days in any calendar month." Therefore, no monthly flat fee alternatives are statutorily available at this time.
The Board could, however, potentially seek special legislation regarding the amount of compensation and
number of meetings per month.
Historical information on the number of stipends paid to Board Members for the past two calendar years is
provided in Attachment 1. Also included is the number of meetings for which no stipend was paid because
no stipend is payable for a second meeting on the same day or for more than six meetings per calendar
month.
Byway of history, Central San's meeting stipend was set at$100 in 1987. It was increased to $170 in
2000 and to $221 in 2007. In 2012, the Board unanimously agreed to reduce the stipend to $185, the
current level. (I n 2016, a majority of the Board voted to eliminate the mileage reimbursement for
attendance at Board meetings.)
The Board of Directors may, by ordinance adopted pursuant to Water Code Section 20202, increase its
compensation above the amount of $100 per day permitted by the H&SC. The Water Code permits a
compensation increase of up to 5 percent once in each calendar year following the operative date of the
April 26, 2018 Special Board Meeting Agenda Packet- Page 46 of 177
Page 2 of 22
last adjustment. That being the case, the Board has the authority to increase the current$185 stipend
established in March 2012 to a maximum of $240.50 in 2018. The Board may also decrease the per
meeting amount or limit the number of compensable meetings per month to less than six.
Included for ease of reference are the same updated annual surveys of compensation and benefits that
were included when the Board first reviewed this matter on March 15:
Attachment 2 - survey of other local agencies
Attachment 3 - survey of cities within Central San's service area; and
Attachment 4 - chart showing where Central San's meeting stipend falls in comparison with other agencies.
Footnotes have been added to Attachments 2 and 4 indicating that Vallejo Flood & Wastewater District's
(formerly Vallejo Sanitation and Flood Control District) Board of Trustees is comprised of all members of
the Valley City Council, and one member of the Solano County Board of Supervisors. Since 2009, the
annual salary of each Council Member has been $14,700. This amount is in addition to the $100 monthly
flat fee for serving as a Trustee of the Flood and Wastewater District.
At this time, it would be appropriate for the Board to conclude its annual public review of Board Member
compensation and benefits by taking one of the following actions:
1. Leave compensation and benefits unchanged; or
2. If a change in stipend is desired, adopt an ordinance (see Attachment 5) amending Title 2,
Administration, of District Code Section 2.04.030, "Compensation of Board Members;" and/or
3. Direct staff to make other changes to compensation and/or benefits.
