Bailey Kenton L.Alm General Manager District Counsel ISSUE A resolution of the Board of Directors is required to accept grants of easements that convey real estate interest to Central San and to authorize recording of the documents at Contra Costa County Recorder. September 7, 2017 Regular Board Meeting Agenda Packet- Page 120 of 294 Page 2 of 5 BACKGROUND Located within the unincorporated area of Lafayette, east of Pleasant Hill Road and north of City of Walnut Creek limits, Developer, Matt Locati, constructed a public sanitary sewer with the Shulgin Road Sewer Project, Job 6594, over two lots (4 and 6 Diablo Vista Way, Lafayette)that are owned jointly by Matt Locati and Pamela Locati, respectively. As the public sanitary sewer was constructed and accepted per Central San's standards, staff recommends the Board accept the signed Grant of Easement (Sewer Purposes) by Matt Locati and the signed Grant of Easement (Sewer Purposes) by Pamela Locati. The Board historically accepts grants of easements by resolution. Upon acceptance and recording of this resolution, Central San will have the necessary land rights as required for reconstruction, maintenance, and operation of this public sanitary sewer main constructed with said Job 6594. ALTERNATIVES/CONSIDERATIONS None. FINANCIAL IMPACTS The easements were acquired at no cost to Central San. COMMITTEE RECOMMENDATION This matter has not been reviewed by a Board Committee. RECOMMENDED BOARD ACTION Adopt a resolution: (1) accepting a grant of easement for an SSE from Matthew Locati on a parcel located at 4 Diablo Vista Way, Lafayette, CA (APN 169-150-007) (ROW Parcel 1 A- Job 6594); (2) accepting a grant of easement for an SSE from Pamela Locati on a parcel located at 6 Diablo Vista Way, Lafayette, CA (APN 169-150-008) (ROW Parcel 1 B - Job 6594); and (3) authorizing staff to record said documents with the Contra Costa County Recorder. Proposed Resolution September 7, 2017 Regular Board Meeting Agenda Packet- Page 121 of 294 Page 3 of 5 RESOLUTION NO. 2017- A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT ACCEPTING ONE GRANT OF EASEMENT FROM DEVELOPER, MATTHEW LOCATI, AND ONE GRANT OF EASEMENT FROM PAMELA LOCATI, AS RELATED TO SHULGIN ROAD SEWER PROJECT, JOB 6594, LOCATED WITHIN THE UNINCORPORATED AREA OF LAFAYETTE, AND AUTHORIZING THE RECORDING OF THE DOCUMENTS WHEREAS, Developer, Matt Locati, constructed a public sanitary sewer main (sewer main) with the Shulgin Road Sewer Project, Job 6594, over two lots (4 and 6 Diablo Vista Way, Lafayette) that are owned by Matt Locati and Pamela Locati, respectively. See attached Exhibit "A" for additional property owner and parcel location information; and WHEREAS, Matt Locati signed a Grant of Easement (Sewer Purposes) and Pamela Locati signed a Grant of Easement (Sewer Purposes) to provide Central Contra Costa Sanitary District (Central San) with the necessary Sanitary Sewer Easements (SSE) to said sewer main; and WHEREAS, said sewer main was constructed and accepted per Central San's standards, and staff recommends the Board accepts the SSEs. BE IT RESOLVED by the Board of Directors of Central San as follows: THAT Central San hereby accepts said Grant of Easement (Sewer Purposes) from Matthew Locati, and said Grant of Easement (Sewer Purposes) from Pamela Locati, as both are related to Job 6594; and THAT staff is authorized to record the documents at the Contra Costa County's Recorder's Office.
